Timeline

If any one has any knowledge of this situation please help me. We need to file for a spouse who was married out of the US then came to America on a visit visa. What forms will we need to use to file the Change of Status of the Visa. The individual prefers to have the interview in America. If this is possible how long will the process take. Thank You.

Option 1: AOS

Thank you for replying to my post. To file change of status all the forms that you have sent in the attachment; do they have to be mailed together? The wife is the us citizen and the husband is Bosnian, he is in america right now on visit visa. So can she apply for change of status here and what order do the forms have to be filled and mailed??

How did this happen?  What was intent when spouse entered the country?  You will really need to prove good reason for plan to AOS and that entry was visit only.

To clarify, they would file for Adjustment of Status (AOS) to become a permanent resident. I know what you meant, but Change of Status (COS) is for non-immigrant status changes. Just trying to make sure we are using the right terminology. :)

 

Yes, the forms should all be sent together. Technically the I-130 (+ I-130A + supporting documents) can be sent first then the I-485/I-864/others later. But since the petitioner is a USC, they can all be sent together (aka "concurrent filing"). There would be additional steps if sending them separately for AOS.

Intent is determined at the port of entry and isn’t an issue anymore and can’t be used to deny AOS. Neither does OP’s beneficiary need any “good reason” to adjust status.

First your person seeking to adjust status needs to be married to a U.S citizen to be eligible, or if married to a permanent resident must make sure his/her visa number is currently available. The following forms will have to be filed concurrently together in one package I-130 (petition for alien relative), I-485 (application for permanent residency or adjustment of status), I-765 (application for employment authorization) and if he/she wishes also add I-131 (application for advance parole). Go to USCIS.gov, print out forms, follow instructions for each form when filling and add documentary evidence.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

What she have B1 or B2 ??

 

Did she obtained it before her marriage or after ?? 

 

If it was after marriage did she indicated in the application that she was married to a USC ?

That's visa fraud and a huge reason the rest of us are patiently waiting to bring our loved ones the legal way. You should go back to your home country while the CR1 is processing and wait to be approved like the rest of us.
