Timeline

Hey guys! 

 

Im filing my 1-485 after my I-94 expired 3 months ago 😩 my husband and I ran into some financial difficulties along the way and only just saved enough money for the AOS

 

Because i am "out of status" does that mean I have to tick YES to the question it asks about violating terms of my non-immigrat status? (Married well within 90 days of arriving on k1 visa) 

 

Anyone else had this issue??

The terms of your visa was to marry within 90 days. There is no requirement to aos within that time. You have not violated anything.

Timeline

There is no deadline for applying for AOS. You can apply even after an year of i-94 expiry BUT the important thing USCIS will look for is if you have married within the 90 days of entering into the country. If you have married within the 90 days period then that means you have not violated any immigrations rules.

It's fine to AOS now :) You don't need to tick yes because you did get married within 90 days upon entry. Just file AOS a.s.a.p now that you are financially able to so that you can get your NOA1 to be lawfully present.

Btw, make sure to download the latest form here https://www.uscis.gov/i-485. Current fee is $1140 + biometrics fee $85. File your EAD and AP together with the AOS and the EAD and AP fees would be waived.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I agree with the other people as well that have responded, just calm down because you are fine. It is normal for you to get married within the 90 day window and to file for AOS out of that window. The overstay that you have right now will be forgiven ONCE you file for AOS so don't worry. My wife and I filed for her AOS past the 90 day mark due to finances as well and there was not a problem at all. So just don't worry and go ahead to file for it. Also don't forget to file for EAD and AP when you file for AOS
