is petition denial by uscis mean a visa refusal (merged)

in 2016 my american fiance she send a petition of alien fiance (the alien fiance was me) and the petition was denied by uscis because we do not respond to the request of the evidence and we did not try again now i am applying for diversity visa i sent my application ds260 and there is a question in it ahve you been visa refused or visa refusal at the port of entry my question is is petion denial count a visa refusal to me

Why didn't you respond to the RFE ?

No, a petition being denied is not a visa refusal. The petition is owned by the petitioner.

Doesn't that depend, though, on whether the application was denied if being deemed abandoned?

Was a visa application ever filed? I think only a petition was filed.

we did not sned request because we decide to stop and not marry i wanna know this petition denial it mean that i get a visa refusal i am the benificary i never meet the consular officer or my case wasnt send to visa center just stop at uscis

no i never filed a visa applications ony petition was filed by her i never meet the consular officer

Since the case never went to NVC and you never filled out the DS160, it never made it to the visa stage.  As stated above, your petition was abandoned, visa was not denied.

As others have mentioned, it never got to the visa stage. Your case was stopped at the petition stage.

If there is a question of: Has anyone ever filed a petition on your behalf then it would be yes.
Visa denial, no because you did not even apply for one.

No it's not. The petition establishes an eligible relationship to apply for a visa, and is the petitioner's. The visa application is completely different. Somebody could technically file a petition for somebody else without them even knowing about it (and have the petition denied for missing evidence).

So at what point does it count as a denial of a K1 visa? Only at interview?

 

Are you saying the correct response is no denial? And that this would not be challenged at the next interview?
