Apply for Naturalization while I-751 is pending

Hi guys,

is it a good idea to apply for naturalization while the I-751 application is pending?! Of course after you become eligible for citizenship, which is 2 years and 9 months from the date of receiving the conditional residency (INC VSC) 

or it may effect the process of i-751 application and make it longer?!🤔

If you want to become a citizen, yes.

Only if you are still living in marital union with the USC spouse that petitioned for your permanent residency. If not, then it is 90 days before the fifth anniversary,

It is very unlikely to make it slower.

The rule is that the I-751 has to be adjudicated before citizenship can be approved. In practice, this means that if you file the N-400 while your I-751 is still pending, it forces the I-751 adjudication, so in most cases should speed it up, and in many cases you may well have a joint I-751/citizenship interview.

In a word.. nothing.

The ombudsman said that they have contacted USCIS and it may take up to 60 days for a response.... 60 days has come and gone.

Contacted a third elected representative...no reply. 

Last infopass in May I filled out a form requesting an expedited interview (for various reasons) and nothing.

 

There are no other avenues to exhaust at this point - I am just sat waiting, the same as I was when it was the 'due to security reasons' BS excuse when my file was in a random country for months.

 

It is now just sheer incompetence.

 

 

I feel sorry for the poor sod who does eventually conduct the interview, as I am not going to be biting my tongue- I have a LOT of questions for them.

It's an absolute disgrace. I think I would be booking weekly infopass meetings and writing to the acting director of USCIS directly.

I was indeed at one point doing weekly infopass appointments- made no difference.

 

If there was anything else I could do I would be doing it, but when even my elected representatives don't respond to my requests for assistance, I really am at a loss.

I highly recommend applying for naturalization before ROC is complete (if eligible)   My hubby's 10 year card was approved almost one-year to the day of filing (1 week longer) and  because we knew we were moving and didn't want to risk missing paperwork, we waited. He was stuck in background checks with ROC, and here we are, stuck in them again (even though only 4 months passed between ROC approval and applying for citizenship- no trips during the 4months).   If you don't want delays, you might as well save some time. (Hopefully) best of luck

I applied for Citizenship this April with a pending ROC. Every time I called them for my ROC, they kept telling me that they are doing background checks. So I thought that if I apply for n400, that will force them to give me a decision faster on my ROC. Wrong! After 14 months of waiting for my ROC, I called them again, the tier 2 lady was very nice, she put in a service request for me and around a week later I got an email from USCIS saying that both ROC and N400 will be adjudecated at the same time. One week later, my status for n400 changed to interview scheduled, so now I am just waiting for the letter to see when is the interview scheduled. So, I guess they will start with the I751 interview first and then move onto the N400 interview.

Conclusion: In my experience, filling for citizenship did not speed the decision for my ROC. However, even with the pending ROC - that did not slow down the process of N400 and I believe I saved some time by applying as soon as my window opened, rather than waiting for my GC and then applying for citizenship.

 

I don't think it'll hurt if you file for N400 while you have the pending ROC, worst case scenario - 2 interviews in one. Good Luck!
