What will work for us?

My husband came here on a 2 year multiple entry visa hes been here since November, we got married February 4th in the USA . We didnt meet and decide to get married till his second time here. His Visa expired Dec 8th but his 6th month extension ends on may 12th. His Father is in the hospital and maybe the last time for him to see him (my husband still in america) his father is in algeria. He wants to leave before filing AOS. I want to know whats the best avenue for us since we havent filed anything. Would him going back and me filing I-130 and K3 the best way?. And how do i go about doing that?. Please any guidance would be greatly appriciated.

If he does return home then yes, file for I-130 for the CR-1 visa.

I'll just add that K-3 is obsolete. It would be better to just go for the CR-1 (instead of filing for and paying for the K-3 only to have it turn into a CR-1 anyway).

t will take a wil before he can come back to th US if he leaves. It will take about a year to get the greancard. and sind he extended his stay on his last visit with 6 months he will most likely not be able to use that visa within that year, to visit you. WHen his father is really sick you have no choice, but it is something to consider.

So were going to go through with the CR-1 how do i get that visa application for CR-1 to fill it out?. We have our i-130 filled out and have most of the documents ready to go

Your husband would fill out and file the DS-260 immigrant visa application comes after the I-130 is approved.  The NVC will inform him when he can fill out the DS-260.  He can not file his visa application with the I-130.
