Hi VJ's

I am a US citizen, I would like to bring my siblings here, but I have questions, if you can give me some advice:

1. Need I one application I-130 for each one of my siblings who wants to emmigrate?
2. Must I include their kids in the  petition?
3. This is an special case: one of my sister came here 6 years ago with a work visa, but, right now is expired (I don't know how long is) Can I file a petition for her without she get in trouble?

Thanks in advance

This will get her in trouble as their is no "forgiveness" for sibling who are overstay, or were to be here illegally. I believe she would need a hardship waiver later on but I don't know what hard ship you could prove to get her to be allowed to stay. She is deportable at this point.

Thanks in advance

1.  Separate I-130 for each sibling.

2.  All of the benefiicary's children must be listed on the I-130.  In 13 years, some may qualify to immigrate, others will be too old.  They can decide then.

3.  You can file the I-130, but it will not do any good.  You sister must have legal status to benefit through an I-130 filed by you.  She does not.  Her only path to a green card is a US citizen husband.
