Filed: AOS (pnd) Country: Brazil
Timeline

We submitted our I-485 via FedEx and it was confirmed to be delivered on March 17. Have not received a confirmation yet (Form I-797C) and check has not been cashed. Our deadline to submit I-485 is April 4. Should I be worried? Is there a way to confirm with their office that this was received?

What "deadline" do you mean? Like an I-94 expiration? If so relax it happens, you submitted before hand so will be okay.

 

For us we submitted 4 days after the I-94 expiration.

 

Also can see by our timeline below it took a little bit to get the text/emails for NOA1's. Hard copy came after.

This is a common asked question. It can take up to 3-4 weeks to receive your receipts in the mail. There are no direct time frames we can give. My I-797's took 20 days to get in.

Deadlines don't exist. If you mean your I-94 expiration, nothing happens if you file afterwards.

Thanks... I was speaking about the expiration date of my fiancé's Visa. But now that I think about it, that April 4 date is just a deadline for her to enter the country, is that correct? It is coincidentally close to 90 days from her actual arrival date, which is the actual deadline I believe we needed to meet.

 

I guess I am just nervous about not getting any notification about getting our I-485 and all other documents in before 90 days after her arrival date (April 10 is 90 days after arrival for us).

The expiration date on the visa means she has until that date to enter the US or the visa will be invalid for use. Once one has POE with the K1, the visa is immediately invalid. The only condition then is to marry within 90 days of arriving.

Preferably people file adjustment of status within the 90 days also so they remain in status, if not; nothing bad, just out of status.

No worries. Assuming she entered on a K-1 visa? And you married before the 90 day window was up after entry, it does not matter when you file the I-485 as long as was married during the 90 days. Again we filed 4 days after the I-94 expiration from entry. Married like days 83 though so again no issues.

 

It can take time to receive the notice as mentioned above.

 

And if a K-1 visa again, the expiration on the visa itself is meaningless really. Upon entry into the US, the visa was voided as it is a 1-time entry. Then the I-94 became her legal status in the US.

There is no deadline to file for AOS. Her K-1 visa expired as soon as she walked out of the airport. She was given 90 days to get married, that's her i-94, not her K-1 visa. There is no requirement to file for AOS within those 90 days, the only requirement is that you get married. Some wait for months or even years to file for AOS.
