Married for 6 years and a child of 4

Timeline

Hi there. I am a Spanish citizen and my husband is a US citizen. We have been marry for 6 years. We married in the US but we have never lived there.We have a dual citizen child of 4 years old born in Madrid. We started our immigration process a month ago sending all the papers to Chicago. My husband is working in the US while I wait for the whole visa process in my home country. Anybody knows if the US authorities have any special consideration with a US citizen 4 year old child for inmigración process? Any idea of the time frame for this situations? And also...any issue about the two of us going to visit the father with an on going immigration process?

Timeline

The process will take just over a year.  There is no special consideration for having a child, but you guys having been married so long and living together for most of that time will help with the approval.

 

You can visit the USA during the process on the Visa Waiver as normal, but you cannot live there or work etc, and must leave when your visit time is up.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, it takes a while. Unfortunately, waiting a great length of time is part of the process we all go through. But there are others who are waiting that long also. This board has regional subforums you can participate in and the members can offer support, guidance, and discuss topics to help get you prepared and keep you occupied.

Timeline

Keep in mind that the child can move at any time, being a USC. You'll have to wait out the process, but can surely visit on VWP.

If it isn't difficult, it isn't worth it.

My husband and I have been married 7.5 years and have lived the entire duration together in Egypt. Our 6 year old daughter also was born in Egypt and has duel nationality. We finally got our case complete at NVC on March-07-2017, and now awaiting to be scheduled his visa interview... we began this process April-07-2016. So yes, it takes about one complete year. I wish you and your family the best of luck on your visa journey.

But he can be without his father? I'm sorry, this is slightly off topic and I don't mean to be rude. But, a father is just as good of a caretaker as a mother. That's why the USC child (regardless if the USC parent is a father or a mother) does not grant any immigration benefits to the foreign parent.

If it isn't difficult, it isn't worth it.

As already mentioned, the child, being a USC, can go to the US to be with the father.

A father is just as essential as a mother and that is why no special consideration will be given to you as a mother.

I'm waiting for my greencard. We started the process 24th march 2016 and will probably not complete it til end of April if all goes well... so the estimates given are correct.  I too have a USC child, and no special consideration is given.

Petition sent to NVC: 18th Aug 2016

NVC Stage

Case number assigned: 8th Sep 2016

Paid AOS Fee: 9th Sep 2016

Paid IV Fee: 14th Sep 2016

DS-260 submitted: 25th Jan 2017

AOS & IV Package sent: 25th Jan 2017

Expedite requested: 25th Jan 2017

Expedite approved (consulate only): 1st Feb 2017

Scan Date: 31st Jan 2017

Case Complete: 14th April 2017 (10 weeks 4 days)

Full expedite approved (bypass NVC to send file to embassy), however too late as I already had case complete 17th Apr 2017

Case arrived at Embassy: 21st April 2017

P4 letter received: 26th April 2017 (expedite at embassy stage so this came from the consulate, not NVC)

Medical date: 26th April 2017

Interview date: 4th May 2017 APPROVED!!

Visa received: 8th May 2017 

POE (entered the USA): 15th May 2017
