Filing n400 with 3 year rule

Hi everyone :)

its been a while since I've been on here (probably since 2012 when we got our green card and then adjustment of status?)

anyway, we're finally ready to file for hubby's citizenship! And the first thing I thought of when I started getting paperwork ready was this forum! :)

 

any tips/tricks?

any idea on filing/processing time? We live in Florida, if that matters.

 

What documents did you include with your paperwork? I have our tax documents for the last 3 years, apartment leases, health and life insurance, car insurance, car loans.. what else do you suggest/have you included?

 

Also, we have our marriage certificate in a foreign language. Does USCIS have specifically approved translators, are we able to choose our own, or do it ourselves?

 

PS we're expecting our first at the end of september. Think we can get approved before then? Or at least any paperwork I can ask our midwife for to include with our paperwork?

 

any advice or point in the right direction is appreciated, as always!

have been contacting NVC, embassy, USCIS, and DoS daily, as of 12/15 our case is in no one's system. waiting for answers..

I just have a question for you. I'll let the experienced N-400 filers answer about the filing. :) Your headline reads "Filing N-400 with 3 year rule", yet your husband got his green card in 2012, 5 years ago? Am I missing something since he would have been eligible to file N-400 in 2015 with the 3 year rule.

yes, after reading through some older threads, I saw where people have chosen the 5yr option rather than the 3yr marriage option. Honestly, it didn't even dawn on me when I started the paperwork. :) it seems the 5yr option is easier and requires less paperwork?

any suggestions on what to include when going the 5yr route?

ive looked on uscis website and the n400 info but it doesn't include much. Wondering what "extras" or tips/tricks others can share :)

I just checked for some specifics.. He got his temp 2yr green card in April of 2011, then adjustment of status and 10 yr GC in April of 2013

So we can go ahead with n400 based on 5yrs as permanent resident rather than 3yrs with marriage..right?:)

Yes, you can tick box 1A for eligibility and file based on that. He would have actually been eligible in April of 2014 based on the marriage then and even in April 2016 based on the 5 year eligibility.

Timeline

Package for the 5 yrs application in order of attachment ( as I did it, no rule around it)

- Cover letter , listing what I attached, helps the agent see if anything was lost in the process, as your paperwork gets transferred around;

- E-notification form G-1145 to receive text messages / emails on status changes

- Check or other form of payment for $725 - naturalization & biometrics - always check the current fee on uscis.gov - Put A# on it.

- Form N-400, SIGNED and DATED

- Proof all earlier marriages ended - if applicable - Divorce Decree photocopy - I certified mine but on the website it says they accept just plain copies as well.

- Current marriage certificate - copy - they don't require it for the 5yr rule, but they require it for the interview so I thought it will stay with the file anyway.

Tip : Write A# on every page you submit, including any copies of other documents.

Tip: Make sure you check your passport for any missed stamps you may have forgotten about. they will go through the passports to confirm travel;

Tip : Make sure to fill all blank spaces you do not intend to fill with N/A - documents get scanned and "read" by computer, if left blank it may misread or error out, in which case agent will have to manually enter data, they will not be happy. Also do not use white out - scanners will read through it and error out as well.

Tip: No staples. You can use a paperclip to hold documents together.

 

And this is it for the 5yr rule. Keep it clean and simple - the agents are humans too and they see paper all day - I would think they appreciate a clean straight forward, organized application. and the easier you make their job, the better.

And this is it for the 5yr rule. Keep it clean and simple - the agents are humans too and they see paper all day - I would think they appreciate a clean straight forward, organized application. and the easier you make their job, the better.

This is very similar to my application. Really good advices!

 

I choose the 3 year option even though I've been a resident for 5 and 1/2 years. Thinking about it, I should have gone with the 5yrs option.

I filled early in February and I'm scheduled for my interview on Apr 13. I'm in Indianapolis.

I, myself had my gc 2008 and eligible to file N-400 in 2011 under 3 year rule but I just chose not to be in a rush. I just applied my N-400 on 2/28/2017 and on tuesday got a text from USCIS that my scheduled letter for fingerprinting is on the way. 

Finally I'm a 🇺🇸 Citizen!!

02/28/2017- N-400 sent!

03/02/2017- Received

03/07/2017- Cashed
