Check was written out wrong

Hi.

 

We just realized we wrote out the check wrong. It was wrote out to USCIS instead of us department of homeland security. I realize because of this the packet will most certainly be returned. Does this mean our entire application will be rejected completely or will they just ask to resubmit the packet with a correct check?

 

What worries me is on the uscis website it says this.

Beginning on Dec. 23, you will no longer have a 14-day grace period to correct a failed fee payment. USCIS will also no longer hold benefit requests submitted without the correct biometric services fees.  You must pay biometric services fees, if applicable, at the time of filing.  We will reject a benefit request if it is received without the correct biometric services fee, as specified in the form instructions.

Timeline

Rejected means that they just send the package back with a note telling you what you need to change/add or whatever before you can resubmit it. It's not a big deal at all, it just causes a little delay for you.

Don't worry! An incorrect check means they will send your package back. But you just have to write a new check, made out correctly, and resubmit. (Take a quick look through your package to make sure no one at USCIS has made marks on any of the pages, if there are any marks, reprint those pages, and then send it back)

 

A "failed fee payment" refers to a check that is deposited, but returned as "insufficient funds" or  refused for some other reason by the bank. If the check is made out incorrectly, it never gets as far as the bank, so nothing gets processed. It seems like at some point (before Dec 23) if they were already processing whatever application and then your check bounced, they'd give you 14 days to make the payment good, or something (I can hardly imagine it, but I guess it's true. Anyway, now that's not the case, and if your check bounces, you're up the proverbial creek. 

 

But that's different from what happened here, so don't worry. Just wait for them to send everything back, correct the check, and re-send it. You're just out the postage.

Not sure if it differs depending on what lockbox or SC that received it, but my i-765 was sent with my AOS package on December 20, it was received on December 23 and then I got it back in my mailbox on January 13. It was the Chicago lockbox.

I have read of some checks getting through with saying uscis. Not many but it seems a few are cashed. Weird.

Hey I read your story and something similar happened to me (about getting my package back) I sent my AOS package on February 14 it was stuck in "transit" for almost 8 days so it arrived yesterday and now apparently they updated the forms on the 17th so my I 485 it's not longer valid so I understand how frustrating this is, I called the 800 number trying to find some answer to my dilemma and the operator says that they don't care if my package was still in transit that the only thing they care about was when they first opened the package and the date on the forms, he said that it might take a moth to get my package back, and everything was on the USCIS officer criteria, I would recommend you, do not worry you'll get your package back and you'll have the chance to fix it

I know on some topics on VJ I've seen people discuss even though they wrote the check out to USCIS they still had the check cashed. They just made a stamp on the check saying us department of homeland security. I know this is only done in a few cases and not all so I do expect to get everything back. However if if the lucky chance comes and they do decide to cash right around when would they do it? Packet was sent out on Thursday the 23rd.

Here's an update everyone. USCIS cashed our check! It comes up on the statement as CSC field office payment. So happy they cashed it and didn't get our packet back in the mail. :)

i did not say it was a scam but with several police men in my family they say do  not answer any questions or give out information when you do  not know who was on the other end of the phone and how do you know and identify them

Can confirm. When we did our I-130 package over 3 years ago, my husband somehow didn't realise he didn't have enough money in his account and the cheque bounced. USCIS sent out a letter asking him to contact the Burlington Finance Center, which he did and paid over the phone with his credit card. It seems they won't be doing that anymore!

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
