Want to send my wife back to the philipinz

i just want to start by saying my wife is a cheater. she has been cheating on me ever since she got here with my neighbor. a couple people have told me. 

 

she is here on a k1 visa. we have been married within the 90 days but i did not submit the 485. no application for green card has been submitted. 

 

what can i do to send her back home?

I would hire a PI so that you can have evidence and be 100% certain.

after that I am sure you can contact USCIS and inform them of the situation.

I would suggest verifying it as well, but if you don't trust her already then the marriage is getting started on the wrong foot. Try to work it out, but if needed, you can divorce. Since you didn't file AOS yet, she will not have legal status once her I-94 stamp expires (should be 90 days after entry). She cannot file for AOS without you sponsoring her (unless she has other immediate relatives in the US already). If she tries to stay beyond the I-94 stamp, you can report it to ICE. That said, there's no guarantee ICE will act on it and nothing you can do to force her to leave.

 

I would suggest that, if it came to that and you plan to divorce, that you just offer to buy her a one way ticket to go home. It's a small cost to pay in the grand picture. Oh, and get a good divorce lawyer!

Thanks. but i dont know anything about the I-94. does she have one? if so, does it expire after we got married? what is that?

It's the stamp in her passport from when she entered the US, which is proof that she is in the US legally. For a K-1 visa, it expires in 90 days after entry. It does not expire at marriage.

are you insecure, she may get along great with a male neighbor, but that dont mean

she's shagging him....and you are so ready to deport her huh...where's the trust & love.

she has admitted to it. my brother in law who speaks spanish over heard her while she was talking to her sister on the phone. she even admitted to cheating with 2. my bro in law is trustworthy. no question about that. hoping i can get some straight answers. not some other visa seekers

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
