My fiance just got here on 02/11/2017 (YAY!)

We just applied for his social security number & received his I-94.

The wedding is set for 04/29/2017

The 90 days is up on 05/12/2017

My question is, because all I see is that we need to file the I-485 (we will file the I-765 & I-131 along with it) as soon as we get married, but how long after we get married is too long to wait?

Does it have to be filed before the 90 days?

The only requirement is to get married within 90 days. You can file for AOS when you feel like it, even after your i-94 has expired. It is recommended to do it before the 90 days are up, but it's definitely not a requirement. Some people wait for years even.

I second what Scandi told you.

It's preferred to file before the I-94 is expired so the foreign fiance(e) can remain in status while if your I-94 is expired and no AOS is filed, it means the fiance(e) is out of status. That's about it.

Yes you can. You just find your local Social Security office & fill out an application & wait in line.

It is free, but you should go as soon as the place opens, we were there for 3 hours waiting.
