Hi i am currently with the love of my life but he always dought me maybe from his marriage he has a child in california he also lives in california he is trying to aee his child but also remove his green card condition he has prove its a real marriage but also prove for having his child and be able to see him he is a great guy i love him to death can anyone help us or answer my question what steps he need to start we cant afford a good lawyer but he can definitely also be a green card holder i want to live with him forever i love him so much i want to be the one for him and help him out

I can not understand what you are trying to say, your BF could create an account and seek advice here himself.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

You both should read this part of who may NOT file an i130 

  A spouse, if you gained lawful permanent resident status by virtue of a prior marriage to a U. S. citizen or lawful permanent resident, unless:
B.  You can establish by clear and convincing evidence that the prior marriage through which you gained your immigrant status was not entered into for the purpose of evading any provision of the immigration laws; or
A.  A period of five years has elapsed since you became a lawful permanent resident; or
C.  Your prior marriage through which you gained your immigrant status was terminated by the death of your former spouse.

 

You may have a few years to hit the 5 year mark

This will not be over quickly. You will not enjoy this.

His divorce is almost final. Right now he is very sick and cant leave the house. He also lost his green card. He applied for replacement but its taking too long. His conditional green card gonna expire in the end of july. His wife was doing drugs and he was the only one watching his son and not working. I met him 6 months after he separated. I am helping him out. He came from France. He hasn't seen his son for over a year

Since he was a stay home dad raising his kid, they didnt have joint account, she filled taxes jointly and she wont give give him a copie. They have a kid together but he cant see him. I am also pregnant and he wants to leave the country cuz he had a better life in his country but i want him to stay. He got hurt a lot and his leg is half paralysed. Shoukd we get a lawyer?

If he's happier in his country maybe you should let him go.  Sounds like he doesn't have a huge chance anyways

If they filed jointly and he has a SSN he should be able to request a copy from the IRS. It's his tax return as well. Why wouldn't she want him to have a copy? Also, if she is doing drugs and not letting him see his kid, he should report that. How is he making a living for himself right now?

 

I also don't understand why him being a stay at home dad affects them having a joint account. That doesn't make a difference, sounds strange.

1 how long was he married before seperating? since short length can negatively impact roc.

2 how long did he have his green card before seperating? since short length can impact roc.

3 what is your immigration status? us citizen, lpr, none? if you are able to help him immigration wise if roc is denied.

4 is child your carrying his? could negatively his roc.

 

some of the red flags I see are the short length of the marriage once he was in the us. the lack of mixing of assets.

 

I would suggest getting proof of wife's drug use and use it in family court to get custody of child and that could also be used to explain the short marriage. but if he really wants to return to France let him and you can emigrate there.

Agree! I'm a stay a home mom right now and we have all joint accounts so really shouldn't matter.

Met a boyfriend still married and only a LPR that is kinda paralyzed, barely works, and has a kid w a USC he doesnt get to see

 

Sounds like the OP is asking how to marry and stay in america with this boyfriend...and oh yeah, now she is pregnant
