I-601 & I-212 Who Files it

Good Morning,

My fiance had his interview this past Monday and was notified that we needed the I-601 & I-212 waivers filed.  As I'm looking over the forms,  I'm not sure if I as the US Citizen am supposed to complete the forms or if he is to complete them, because it does need his signature, I do believe.  So, can he do the forms, mail them to me, and I submit it with my letter of hardship and letters from family, friends, and employment?  Just trying to get an understanding on the correct and best way to do this process.  Thanks!

I see.  You file it I believe to the Phoenix lock box.  You need to prove why you'd suffer a hardship with him not here as well as why you can't go to be with him.

Ok. So, I'll do it even thought the questions are pretty much about him? And I'll sign in the applicant signature box?  I just don't want to do sign that if it is actually for him to sign...I don't want to delay the process any longer than it needs to be and throw away $930 either.   Thanks for the reply.

I recommend checking out immigrate2us.  It's a little difficult to navigate but lots of experience with these matters.

I would highly recommend contacting a lawyer. This is one case that a do-it-yourself approach may not be advisable. You need a really strong case for a waiver (i.e. hardship or medical emergency) and it needs to be framed in exactly the right way. I think most people on VisaJourney would agree that hiring a lawyer for this procedure is advisable.

You'll need a waiver atty especially if his probs are

past crimes & immigration.

Its not just forms to be filled out, you will need a 

brief, hardship letter from you why he has to come

here, evidences of the hardships claimed,and he

forms he would sign,

The atty you use dont have to be in your state &

some has payment plans
