Hi Everyone!

I don't even know if this can be answered here because it's a US immigration site, but hoping a fellow Brit can tell me...

Basically, when I met my husband and got engaged, I went to the UK on a marriage visa, obtained it, and we got married in 2012. Shortly after, we made the decision to immigrate here, and after talking it over with my immigration lawyer, there wasn't really a process I had to follow, so I just let it expire.

We have a vacation planned to go back in February and visit family, but my passport (still says maiden name, but I'm bringing marriage certificate) still has the expired visa in it. I contacted my immigration lawyer from when I first went, and she said since it was just a visit and ten day vacation, they should let me in. But the "should" had me a little worried. 

 

In my mind, it shouldn't be a big deal, as my husband has a current us permanent resident card, so that alone shows we have no intention of staying... along with our tickets that show a return flight the next week, and me assuring them I DO NOT want to move to England.... but since I've been held over at heathrow before, it scares me a bit as to if they are going to let me in?

Any advice or added evidence I should bring to ensure they don't give me too hard of a time??

July 30,2013 - Evidence Returned

Aug 2,2013 - NOA2 Approved (10 Days)

Aug 28,2013 - Email Received Stating LND # (They Sent Packet 3 on August 27th)

Aug 30,2013 - Packet 3 Received and Sent (DS-230 Part I and II, DS-2001, and Cover Letter)

Sep 4th, 2013 - Medical

Sep 19, 2013 - Packet 4 Received

Sep 27,2013 - Interview - *approved*

Oct 02,2013 - Passport Packet Received (3 working days)

Oct 11th, 2013 - POE Los Angeles

Oct 21st, 2013 - SSN Received
Nov 14th, 2013 - Greencard Received

Hi there, 

 

I'm certainly no expert on this as I'm only just freshly in this situation myself! My husband flew to UK on a marriage visa in Dec and we were married during his stay and now he's back in the states... We never assumed there would ever be a problem in the future if he ever decided to visit the UK again. I don't see why they would have any problem, you entered on the marriage visitor visa, got married and returned to the US. Plus as you said you have proof of a return flight etc. Maybe just bring a letter from your employer if you can as further evidence incase you do get held for any further questioning. But I reckon you have nothing to worry about!! I'd say there are plenty of people travelling back to UK with an expired marriage visit visa in their passport ^_^

We got married there on a marriage visa, but it wasn't a visit one, it was for living, because I initially thought I would be staying.... but I really wanted to come back to the states, so we decided to move. Thanks for your reply! :)

Ohhh right! Sorry, my bad! Well anyway best of luck, I'm sure you have nothing to worry about and hopefully someone here will be able to reassure you with personal experience! :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I've actully read a little a put this as I'm living in the UK with my husband on the spouse visa, but we are moving back the The US next week.  From what I've read from others you'll need the basic proof that you normally would when visiting, but also to bring your brp card.
