After 2 yrs of marriage - Green card with conditions or without

We filled for i-130 & i-485 in April 2016. We havent heard anything about our case. Our 2nd marriage anniversary is coming in March. If we get an interview sometime during the first quarter of 2017, and if we get approved, will we get a 2 year green card with conditions or 10 year green card? Does anybody know?

05/06/2016 - USCIS Email/Text acceptance confirmation

05/09/2016 - NOA1 hard copy

05/13/2016 - Biometrics letter arrived in mail

Timeline

If you are married 2 yrs before entering the US you will get a 10 yr visa. If they don't change it at the embassy make sure you tell them at POE. that you have been married for more than 2 yrs

If you get the decision on your case before your second marriage anniversary, you'll get a 2-year GC. If you get the decision after your second marriage anniversary, you'll get a 10-year GC.

If you are married 2 yrs before entering the US you will get a 10 yr visa. If they don't change it at the embassy make sure you tell them at POE. that you have been married for more than 2 yrs

OP is doing in-country Adjustment of Status, so this isn't applicable.

If you get the decision on your case before your second marriage anniversary, you'll get a 2-year GC. If you get the decision after your second marriage anniversary, you'll get a 10-year GC.

OP is doing in-country Adjustment of Status, so this isn't applicable.

i had my interview after the 2 year mark and got the 10yr GC.. made things much easier as i didnt have to do ROC! 

so yeah, the interview person will know and u will get the 10yr GC as long as the decision is after the 2yr anniversary!! u will save $500 and the ROC headache!

Thank you guys for the reply. Our interview is scheduled for 9th Feb.....about a month before our 2 yr anniversary. So we might NOT get 10 year GC :(

You probably wont...that sucks...you can see about rescheduling it? I heard that doesn't always work tho.

Why in the world would they want to reschedule? Better to be done with AOS and ROC is a piece of cake if it's a genuine marriage.

You are right, we better be done with AOS. I have no issues doing ROC, its just the amount for ROC is too high to be paid especially if we are so close to our 2nd anniversary. We have a kid together, genuine-ness of the marriage is something we can easily show with joint properties, finances since we were together for 6 years before we got married.

because the timeline may be like 1 week! for one week they have to get a 2yr conditional and pay more money like 500+. of course it is genuine but when you are that close to the deadline for a 10yr it would be easier to just wait a few weeks!

that's not going to work. unless they agree to intentionally delay adjudication until after your anniversary (I don't see why they would), you'll get a 2-year GC. it's not a matter of discretion. it's automatic.

Thats good information. I always thought it was in the hands of interviewer to give 2 yrs vs 10 yrs

I believe usually within a couple of months. It depends on the local office.
