REF received please Help date line Feb 16 2017

Hi everyone,

1 year ago my husband and I sent to Vermont USCIS office as many proof of our bona faith marriage,after 1 year we have got a REF asking for more evidence of bona faith marriage but they do not want me to send copies of what we submitted already. What else we can send? This is so frustating and is driving us nuts!

We appreciate advices from people with similar cases.

They are asking for more evidence during the period of our marriage. We have 4 years married. We do not keep bills from 2013,2014 I don't know if we have bills from 2015. Bank statements with withdrawal and desposit we can get it from our bank, health insurance, joint lease, 2015 taxes and we have appointment in January for 2016 taxes. Our concern is they are asking for evidence for 4 years of marriage and we do not keep nothing else, just the old evidence they do not want we send again and new evidence from 1 year ago.

Most bills can be obtained online nowadays. Otherwise try call your utility providers? Maybe they can mail the bills to you?

call companies they usually keep records back a good few years you should be able to obtain them... pictures you have taken together at major holiday like christmas or thanks giving, life insurance policies to show your the beneficiary, if you've gone on any vacations save the receipts or reservation details, have you gone to any weddings you an invitation for? any credit cards you can be added on as a authorized user, any future plans you can show deposits for the upcoming trip? car insurance? even if you don't have a license your name can be added under spouse, is his car paid off? if so go to dmv get your name put on the title, have your name added on as an authorized user on whoever you have cell service through

No, they do not want you to send copies of what you already sent, they want additional evidence. If they wanted the same evidence why would they send a RFE?

OK - you need to first stop, breathe, and push your panic away.

You sent info last year. Unfortunately for you, the rules say they need info FROM WHEN YOU MARRIED, and you don't have that info. So other than try to get that info as other have suggested, your best strategy is to send good info from the last year.

1. Prove you live together (current copy of lease, mortgage, driver's licenses)

2. Prove you bank together (joint statements, joint credit cards, joint loans)

3. Prove you take care of each other (medical insurance, house insurance, car insurance)

4. Prove that you have planned for the future (wills, medical powers of attorney)

5. Prove that you travel together (airline tickets, hotel bills, stamps in passport)

6. Prove that you report and pay your taxes together (tax transcripts for all years - even you sent these already)

Write a cover letter and explain that you have not kept copies of bills that have been paid (if you cannot get copies from the utility companies). If you don't have something, then state that in your letter.

Remember - just because you cannot provide the info they want to see doesn't mean the non-USC will be rejected. It will mean that you both will be called in for an interview.

We got an RFE many months after we submitted our ROC petition, so I know how you feel. Here is a post I made after we sent in our RFE response:

I was a bit down after getting the dreaded blue letter, but obviously we didn't send enough information. Let's hope our response is sufficient. We got our RFE on April 8, 2016 and we just sent the response yesterday (May 3, 2016). It totaled about 500 additional pages (single sided).

The majority of the pages were bank statements with transaction pages (about 60 statements - 150 pages total) and credit card statements with transaction pages (about 80 statements - 200 pages total). We had only sent samples of these statements with the original petition, so hopefully we've addressed their concerns.

We were unable to get utilities in both names, so we never sent them with our original petition. We did send copies with the RFE response (at least as many copies as we could get). With each one we included a note explaining that we couldn't get them in both names; we also highlighted which joint accounts/credit cards to look at for payment.

So that's how we handled the RFE. Fortunately we received our approval not long after this message was posted. I hope you have the same luck!

Taxes you can get online if they show joint, especially on the 1040 where names are included and they are easy and fast to get. Leases for apartments, car payments, medical, dental, life should all have effective dates for you. Just start from scratch and assume they have nothing. Anything and everything you can get your hands on that shows you have been together send in. Pictures that show dates and times, past travels with receipts, boarding passes. You really should be able to get more than enough info. We just had our AOS and we took in the last six months of everything. I did intentionally put my spouse on about everything once he got here and we got married though. If you are not on utitility, cable or anything like that just call them and get your name on them then save them each month.
