K-1, K-2, CR-1? [split topic]

That is the law, however there are ways around it. I had been in Ecuador for 4 months and A month before I got married, I made a trip to Colombia. So when I got my movimiento migratorio (which shows entrances and exits from Ecuador) they told me that the clock had been reset and I couldn't get married yet and would have to wait another 75 days. But they also told me that if I went to the Registro Civil in Quito we could get married by exception (Matrimonio por excepcion). It was a bit of a hassle but its doable. I also have another friend who was only in Ecuador for a week to get married and she managed to get everything done in that time.

Hi, I just returned from an 11 day trip to Ecuador (November 2016). My fiance' and I went to Quito to try to get married. It didn't happen, but we were given a long list of items that were required. They mentioned that I needed a K-2 visa stamp in my passport, I had a K-3 stamp. Do you know how I can get the K-2 visa? Also, they needed proof that I was single. The only thing I could find from the USA is an affidavit that I sign and have notarized stating that I am single. I was going to go to the American Embassy to have it notarized, but they were closed...it was Thanksgiving day.

Can you give me some insight on how to get this all accomplished? I'm just starting the K-1 Visa process to bring Jorge here to the USA for marriage. It is a long process and I would like to work it out so we can get married in Ecuador instead... hopefully in April or in July, 2017. Any info you could give would be appreciated. Thank you!

05/17/2017:     NOA2 (Received May 22, USCIS still shows as received)

05/23/2017:     Case mailed from California to NVC

06/02/2017:     Case Number Received (I called) from NVC

06/09/2017:     Case Status: Ready in Guayaquil, Ecuador

K2 visas are for minor offspring of the K1 beneficiary. Were you trying to bring a child with you?

K3 is obsolete. No longer used.

If you marry in Ecuador, you no longer qualify for the K1. You will have to start over with a CR1.

You mention a long prcoess- no immigration process is fast, but if speed is something you want, go for the K1.

The K1 fiance visa would be a much faster way to get him to the USA than the CR-1 spousal visa; the K1 currently takes 5-6 months, and you could file immediately. All going well, he could be in the USA and legally marry you here in June. Once you apply for Adjustment of Status, and get a travel permit, you could go back to Ecador and have a ceremony there to celebrate with friends and family.

The CR-1 would start after you marry in April, and takes about a year, so you are looking at April 2018 by the time he could come to the USA. On the positive side for the spousal visa, it is significantly cheaper, and he can work and travel right away.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you for your reply. I realized I made a mistake. I had a T-3 stamp on my passport, but need a T-2 visa.
