Hello VJ members






i got few questions from a girl she is from another group i am on it









She got married at 15 yrs her husband is in the USA now



She is in morocco Now






So here is the Questions :






1) is it gonna be a problem if he applied for cr1 visa even she is almost 16 yrs



2) he is married with her now but he Just applied for K1 can he Cancel it and Apply for CR1

Any K-1 he filed was automatically invalidated when they got married.

A CR-1 would be the correct course of action now they're married. I don't believe there is any minimum age as a beneficiary for the spouse of a US citizen if the marriage was legal in the jurisdiction in which it was performed. Obviously, if there's a substantial age gap (and since we're talking a 15yo child married in Morocco then this would seem possible) then this may call into question whether the marriage is bona fide or not.

There arent min age requirements for the beneficiary- however there are the issues of the marriage being legal in the place it occurred and the other side of the issue being the marriage has to be legal (recognized) in the place where you are going to live.. This was/is sometimes an issue with gay couples or cousin-second cousin marriages. I can see it being an issue with an underage person maybe? You should check into state laws... If the state they intend to live in wont recognize a marriage between an adult and a minor then the embassy wont approve the visa.

Applying for a CR1 won't be an issue unless they were already married when they applied for the K1 and lied.

Worst case scenario is that they just have to wait until she is 18, but I don't think there is harm trying now.

Maybe some of the other Moroccans know more, but if they haven't been given special permission by a judge and are just religiously married, does that still count for immigration purposes to the US? I don't know if that is the case here, but that might be an obstacle.


this forum is not meant to be judgemental by any means but this is a difficult situation due to it not being normal in the US or even in Morocco..... the idea of child brides is quite sensitive in the US. I don't even know how to understand how the interview would go with a minor.... is she even allowed to sign forms being a minor? does she need parental consent? I don't know these answers but I really would hope that this kind of thing would not be allowed to happen through our (US) immigration system.

I don't know how the US views these cases abroad, but usually someone under 18 who is married is emancipated and can sign their own forms in the US.

It is socially and legally acceptable in some countries. I completely understand that and have zero problem with it.
To me no different then when a 75 year American marries a 25 year old Russian as long as they are both in agreement more power to them.

The issue with the OP's case is that it may be legal in the foreigners country to take a child bride but State laws here might get him in trouble.

To me no different then when a 75 year American marries a 25 year old Russian as long as they are both in agreement more power to them.

My opinion is not the question. The question is what type of problems would that man have bringing a 15 year old wife to America where it would be illegal to have intercourse with her.

BUT since you asked I think 18 is the minimum age that someone should get married. Why not enjoy being young and single for a while. Plenty of time to tie the knot.

What age do you think should be the minimum?
