Hello, I was wanting to get some help with where to begin with the I-130 and I485, and what should I expect. I haven't been married to my husband very long. He is a Jamaican citizen who came over on a B2 temporary work visa. We met a year after he had been here and got married soon after. He has overstayed a little while. I guess I'm wondering where do I start. We have some things to prove our marriage is real, but I am afraid we may not have enough. We did not have a big wedding and I don't have a lot of family, so I am wondering what do they consider real? Maybe I'm overthinking, I want to do things correctly. Can someone please sheds some light on this matter for me. I would appreciate any help that is offered thanks in advance.

Read this guide http://www.visajourney.com/content/i130guide2 fill out and mail in all of the forms listed with payment. There is a list of what can be submitted as proof of a bonafide relationship. Your husbands overstay won't be an issue due to his marriage to a US citizen. If you have any further questions, feel free to ask them.

Good luck.

It is not unusual for newly married couples to not have a lot of evidence at the start of their relationship, especially if one was out of status and living a bit under the radar.

Follow the guides and submit what you have. Then continue to build the proof and bring that with you to the AOS interview.

Trust in the fact that your relationship is bona-fide and keep every piece of documentation possible. ?

Good luck!

P.S. As others have stated, a small wedding is not a deal breaker. My husband and I had to go to Maryland to get married since that was the closest state to Florida where we could legally do so. It was just the two of us and the officiant. I guess that's as small as it can get. ?

As I keep reading I find more and more positive information, that helps me ease my mind about getting the papers right.. We are on each other accounts, he is on my health insurance through my employer and the beneficary of my retirement account. I know that everything is real, it is just proving it on paper. I thank you all for help. I do have another question is there a particular time that we should file.

If he is currently out of status, I would file as soon as you have the initial paperwork ready.
