I-751 ROC Questions

Hi all, we have finally reached this stage and are putting the package together for submission in mid-December. I have a couple of questions regarding the I-751 form. In Part 5, do we put all children regardless if they are petitioning with us (i.e. my wife's adult son who still lives in Russia will not be part of this petition, so do we include him? Also, we do not have any children together).

Secondly, I would like to get other's insights into how to fill out Part 11. Is this used as a type of catalog for the additional information included (i.e. we are planning on including bank statements, taxes, photos, utility bills, insurance information, trips we took together, cards, etc.) or is it for some other purpose?

Lastly, for the affidavits, do we need to send the originals? Most of the affidavits we will have will be originals, but we have one close friend that now lives in Arizona who plans on submitting one and I want to know if she can just send it to us electronically after it is notarized?

Regarding part 5:

Provide information on all of your children.

Ref: Page 3, https://www.uscis.gov/sites/default/files/files/form/i-751.pdf (emphasis added). The key is to answer carefully the last two questions in each child's section about living and applying with you.

The Part 11 space on the form is for additional information related to the specific questions listed in that form. The instructions also indicate how to label/attach additional information, such as, documents/statements, etc. Which you should do with any document you submit.

From Part 11 :

If you need extra space to provide any additional information

within this petition, use the space below. If you need more space

than what is provided, you may make copies of this page

to complete and file with this petition or attach a separate sheet

of paper. Type or print your name and A-Number (if any) at the

top of each sheet; indicate the Page Number, Part Number,

and Item Number to which your answer refers; and sign and

date each sheet.

If you are going to go through the trouble of affidavits, send in copies. Refer to:

Copies. You may submit legible photocopies of documents requested, unless the Instructions speci cally state that you must submit an original document. USCIS may request an original document at the time of ling or at any time during processing of an application, petition, or request. If you submit original documents when not required, the documents may remain a part of the record, and USCIS will not automatically return them to you.

We sent in affidavits, and in retrospective, I think it was a waste of effort. What USCIS adjudicators currently seem to want is a lot of "marital bonafides" evidence, since the inception of the marriage. That is their wording when we received our RFE notice. Refer to:

Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered in “good faith” and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you can to establish this fact, to demonstrate the circumstances of the relationship from the date of the marriage to the present date, and to demonstrate any circumstances surrounding the end of the relationship, if it has ended.
