What to bring to POE with a pending CR1?

Hi VJ'lers,

my husband was going to come visit me in December to spend the holidays with me and the fam. Now due to some unexpected issues in his business he can't come see me. I now booked my ticket. I got my new ESTA approved today. I had to get a new one since i changed my name in my passport.

My attorney told me to not fly since there is a big (? <_< -must not be that BIG since a lot of ppl made it through ) chance of being turned down- now after reading on all the success Storys here on VJ of all the Couples that made it through the border with a pending I-130 i went ahead and booked my flight.

I am flying into Seattle and i really don't want to be turned down by the BPO. What should i bring? Our i130 is approved and i am literally just waiting for my interview at the consulate. Petition is stuck at NVC at the moment.

Evidence of petition approval, return ticket (obvi), letter of expected return from employer and apartment rental contract was what I used to carry (visited twice during my K1 process). Was never asked for any of it, and had no issues getting in.

i already read through this thread. I just got an E-mail back from my attorney.. she advised me to 'stay put' :huh2:

I think she just doesn't want me to blame her in case i do get turned down. I'll take my chances i guess.

Don't listen to her. Why do you even have an attorney?

If it isn't difficult, it isn't worth it.

Immigration lawyers are known to give bad advice. It's the refrain on VJ.

If it isn't difficult, it isn't worth it.

She's covering her legal behind.. and playing it ultra-safe.

As long as you carry proofs of ties to home and a return ticket, you're likely to be ok visiting.

Don't speak up unless they ask for it.

Be honest. Bring what they suggested ahead of me.

You can be turned down. Then you have to fly back and that is the worst case. (It won't hurt your case)

I hope you are not paying the attorney a-lot.

Don't fight or panic with them. Stay calm and just show them what you have.

6/12/16 - Preparing to send packet to USCIS

6/27/16 - Sent Package to Chicago lock-box via UPS

7/5/16 - NOA1 Text/Email / sent to Potomac (Hardcopy 7/10/16)

8/3/16 - NOA 2 I-130 Approved! Case sent to NVC! (Hardcopy 8/6/16)

8/19/16 to 9/4/16 - Visited wife for two weeks in NL. =}

9/1/16 - NVC Case and invoice # received. (Email) Finished DS260 and Paid AOS Fee.

9/8/16 - IV Fee Paid!

9/16/16 - DS260 Finished!

9/27/16 - Sent Documents to NVC.

11/21/16 - Called NVC. Case reviewed and accepted on 11/18. Waiting for email/mail.

11/28/16 - Got Email stating we are now waiting for an interview spot!

12/11/16 - Got the interview date! 1/12/17!

1/12/17 - ...ACCEPTED SHE IS NOW WAITING FOR HER PASSPORT IN THE MAIL! =]

1/18/17 - Passport and visa in her hands! We now wait till 2/24 for her to fly to me! (Has to finish work contract)

2/24/17 - She is now here with me! POE was simple,she only took 10 minutes with them checking her visa! "Welcome to America,missus"

3/15/17 - SSN Card Received.

4/10/17 - Greencard Received.

 

Preparing I-751 (ROC)

11/26/18 - I-751 Prepared and mailed out.

11/27/18 - UPS Confirmed Delivery at 10:30AM

12/3/18 - Checks cashed and got Email/Text With Receipt #

01/3/19 - Extension letter received.

I did this multiple times in a B1 visa. I told them I was visiting family, on vacation etc. They never asked any specific questions of who I was staying with. Brought proof of pending case just in case. Good luck

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Thank you. I am so nervous. I hate flying so much, i am so scared everytime.Just the thought of me flying all this way and getting turned down is making my stomach cringe. I mean they will see how many times i have visited in the past. I never overstayed and always left on time. I just hope that i won't have any problems. I'll bring a copy of my approved I-130 as well as the paid IV fees and maybe i'll have an interview by then at the consulate here.
