Going for K-1 Visa

My boyfriend and I (I'm the citizen, both of us are living in Argentina - home country -) have decided to go for the K-1 Visa. We want to move the US, get married and live there permanently.

I have some concerns regarding, in the first place, the fee. I've contacted the US Embassy and they said we have to pay the fee to USCIS (we can't pay it at the Embassy) so I'm assuming it has to be a check from a US bank account. The problem is I don't have anything - much less a bank account - in the US. Would it be a okay if a friend of mine (LPR and living in Florida) does the check for us?

The other issue is the affidavit of support. I know this only comes up in the last stage of the process - the interview - but I'm worried because the last time I lived in the US I was 12 and therefore never worked (never worked here in Argentina either because I've been going to college, so I didn't file taxes), and don't have any assets either. If I was to move back to the US in the middle of the K-1 process (a few months before the interview), would proving I am currently living there and have a job be enough? Because it would only be a job I've had for 2 or 3 months...

You can pay by bank drafts, cashier's checks, certified checks, personal checks (See Check Instructions below), and money orders must be drawn on U.S. financial institutions and payable in U.S. funds. (see http://www.visajourney.com/content/paying-immigration-fees).

You will need a co-sponsor at the interview stage and that can be a friend or a family member, LPR or Citizen.

I've read those links already but what I just can't seem to find the answer to anywhere is my second question; I have a friend who's an LPR and has been living in the States for +15 years.

The problem is atm she's living with her partner and her two kids so I think her income would have to be much higher than it is for her to qualify as a co-sponsor (I think by March next year she's moving out on her own though, so she might meet the criteria to co-sponsor).

If she does meet the criteria, is it possible for my I-134 to be blank since I would still be living in Argentina and therefore have nothing in the US and for her to be my co-sponsor only?

No, unfortunately, if you can't get a co-sponsor, it won't be accepted and it can't be blank. The purpose of the Affidavit of Support is to show that you can support your immigrant fiance and that he will not become a public charge.

For your first question, you could have someone get you a Money Order from the US to accompany your petition. As for the second question, yes, having a job and a home here, will help a lot as long as it exceeds the 125% Federal Poverty Guidelines. You might be required to have a co-sponsor because you won't have much in the way of work history.

What I meant is if this friend of mine meets the income criteria for her to become my co-sponsor, is it possible for MY Affidavit to be blank since I don't have anything in the US considering SHE will be my co-sponsor.

Yes, your friend can make out the check.

Yes, your friend can be a co-sponsor. You still need to fill out the I-134, but don't need to meet the requirements. Showing that you intend to take up residence in the US may be important, but looks like you are planning on doing that (getting a job, lease, bank accounts etc).

If it isn't difficult, it isn't worth it.
