CR1 Visa - Income question

Hello everyone,

I need some advice about utilizing a household member(i-864A) to help my wife immigrate to USA from Thailand. The household member is my father. He is retired and has an income of approximately $10,229. Also, he has an IRA in excess of $220,000. I have be living abroad for 4 months this year, therefore my income does not meet the limits as described by the federal poverty guidelines. Our currently expected combined income is over $27,000. I understand that the house and property are an asset. However, my question is this: Is it better to just use income and not mention the assets, or would the assets strengthen the case?

What is your current and ongoing income? Can you prove that with paystubs and a letter from your employer? If you are now gainfully employed, then not having income for 4 months last year should not be a problem.

If you are going to add dad, I would definitely include assets, as his income is so small.

Thank You for your reply,

My income is around $450 per week at the moment, I just arrived back to USA about 6 weeks ago, I have an employment verification letter, and paystubs. but I will not meet the federal minimum by Dec 31.

6 weeks is short, but it may be enough, especially if it is a well paying job. It is anualliSED income that counts, not annual income in the last year.

$450/week before or after taxes. Take your pretax income per week x 52 = current income regardless of how many weeks you have worked this year as long as it is a permanent fulltime job.

A house and propety can only be used as assets if they are not your only home. The assets need to be professionally assessed and the amount owed (in this case the mortgage) subtracted from value.

If you have no children and haven't sponsored an immigrant before, then for your family of 2 (you and your spouse) you need to make $20,025/year and you make $23,400 according to the information you provided us. That required amount will increase in 2017 but not by much.

I would apply with your current income and see what happens.
