File form I-90 because USCIS made an error on your Green Card.

  • If you are filing the Form I-90 because your current Permanent Resident Card (Green Card) contains incorrect information due to a Department of Homeland Security error, such as a misspelled name, you do not have to pay a filing fee.

However, you must send us:

  1. The original card that contains the incorrect information; and
  2. Evidence documenting your correct name or biographical information.

Done with K1, AOS and ROC

What? That isn't the case at all. No one needs to apply for citizenship and the card should be a 10 year.

OP, you can contact USCIS by phone about it for clarification, but I believe the process is to submit an I-90 without the fee and check off the box that indicates that there was an error.

what is your question?

That is not a thing. Stop. When someone files for ROC to receive a 10 year card, then that is what they are supposed to get. They do not issue them with varying expiration dates based on when someone may be able to apply for naturalization. No one has to file for that and can stay a permanent resident as long as they choose to and are eligible. The OP wanted to know what to do to correct the incorrect green card they were sent.

OP> Make a copy(front and back) of your incorrect green card to keep for your records before sending off anything. Make an infopass appointment to show them the mistake, and that you are in need of sending back your green card with an I-90 because of a USCIS mistake. Ask them to place a temporary I-551 stamp in your passport so you can work and travel while waiting for your corrected green card. For a USCIS mistake, there is no fee to file the I-90.
