To be divorced within first 2 years of GC, need lawyer to file Form I-751 and wavier?

Hello,

Unfortunately I am getting divorced from my wife who is an American citizen. We have been married for a little over two years, and I submitted my adjustment of status application early Oct. 2014. But due to the current application process delays within the USCIS I didn't get my conditional residency (Green Card) approved until 9/11 of last year. No time off for good behavior or consideration for time already served.

The uncontested divorce application has been handed in, and here in Texas there is a 60 day waiting period until the divorce can be finalized.

So I need to file Form I-751, and I believe a Waiver of Joint Filing due to Divorce as well.

What I'd like to ask is if anyone has experience with filing like this, or if I should go get robbed by an attorney who wants $2500 + filing fee to do this for me?

You can file your I-751 with divorce waiver if you are competent in reading and following the form instruction.



Pretty easy to do on your own, just check the "divorce" box on the form, attach your divorce decree and proof of bona fide marriage (mainly financial co-mingled documents).

Once you get your divorce decree ypu can file your I-751 with coverletter stain you are filing removal of conditions early due to divorce. That's your divorce waiver.

Submit with all your good faith evidence and that's that.

There is at least one or two other Scandinavians who have had success with this recently on VJ that I can think of off the top of my head. I believe without a lawyer as well.
