So I just checked my case status online and it says I've been denied. I haven't received the letter yet and they cannot tell me why on the phone. I'm certain I filled out all the correct documentation but I never received an interview letter. Is it normal to be denied without an interview?

I'm really freaking out as I've just started to really get my life going here with a great job and I'm terrified I'm going to lose it all and have to be away from my wife!

How many people actually get approved an appeal? Even if I am granted one

Your advice is wrong. Once the AOS case is denied, the EAD becomes invalid. It doesn't matter what the expiration date is. OP - you would be wise to ignore this advice. Google "working on EAD afte

Your EAD is invalid now.

Did you get any RFEs?

The only way it would be denied without interview is if you failed to properly respond to RFEs, you missed an interview appointment, or you married after the 90 days.

If you think you might have missed an interview appointment you might be able to get the case reopened.

Have you moved or changed your address? What's the last thing you recieved in the mail? Was there any other updates shown online that you may have missed?

You can call USCIS up and ask if you missed an interview.

They asked for more information on my mother in laws income as a co sponsor and we sent tax transcripts for the last few years!

You can't work. You'll have to stop until you get a new EAD.

Sounds like your did not satisfy them with the RFE ... they usually send out two before they deny if they don't get the right response. Maybe you missed a RFE.?

Tell everything on your case so it's easier to help you.

Sometimes if you fail to properly respond to the RFE they will deny. They give you two chances and if you still don't have the correct paperwork they can deny.

Did you send in your response to the RFE recently?

What exactly did you send? What is your MIL's household size? Does she file joint taxes?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Tough break. That is another one of many problems with RFE's. Sometimes they only give you one chance to satisfy it.

Once you get the denial letter make sure it details the reason for denial. That way you will know exactly what they expect from you. Sorry about you situation with not being able to work in the meantime.

It's most likely to do with the RFE. If your mother-in-law filed taxes married filing jointly, you may need to get her husband to fill out an I-864A for your re-filing.

Don't panic. You certainly have to shell out another $1070 and that's not fun, but I'm sure second time will be the charm. :)
