Which Name Do We Use?? Help. I'm so confused.

I am so very thoroughly confused at the moment.

I am USC, and am petitioning to have my filipina wife here with me. We were married in Philippines on 12/15/16.

Wife's passport is in her maiden name.

Filed I-130 in August and used her married name. (advised to do so by forum members)

Case has now been received by NVC. I have paid my first set of fees, and I am waiting for the payments to process.

Next step is to complete the Application for Immigrant Visa.

Here is my question. When I fill out the Application for Immigrant Visa (DS-260) do I use my wife's maiden name or married name?

** If I use her maiden name, then the DS-260 will not match the I130.

** If I use her married name, then we need to change her name on the passport. This will take quite a bit of time to change the name on her passport. Would need to wait on the passport before completing the DS-260?

What do I do?

Follow the name you used on the I-130, don't start creating new problems.

Get CFO done, take the certificate (along with other listed requirements) to DFA and get a new passport . Of course pay for an expedite

If you want the green card in her new married name you have to get a new passport in her married name. Otherwise they will issue the immigrant visa in her current passport name regardless what I-130 says.

How about in my case guys, when fiancé fill up for the k1 petition he followed my passport name which is without my middle initial while my birth certificate has my middle initial. Did we do the right thing?

By the way all my docs has my middle initial only in my passport don't have ( the dfa decided to take out my middle initial since I'm illegitimate child) should this cause any problem in the interview? How about when I fill up the ds160 should I still follow my passport and my application? ( without my middle name) or follow my birth?

Follow the name in the passport for your DS-160.

Do make sure to include an AKA for the NBI being you name with (or without) initial is "other name used"

Get a new passport with her married surname and complete all documentation using that format. It will be MUCH easier down the road if you start process now to establish that new identity than coming into the US using her maiden name and THEN changing to US IDs later using your surname. Take it from my experience. It's a real PITA having to re-deal with SSA, BMV, etc. more than once.
