AOS for parents of USC from B1/B2 Visa

Hello all,

I have filed N-400 and am awaiting interview to become citizen. I want to petition for my parents who came here over 15 years ago on a B1/B2 visa. About 10 years ago, they filed a LULAC application to adjust status but application was abandoned because we moved around the same time and did not get the interview letter on time. We were advised by a few attorneys at the time that we could not do anything. Would any problems arise for them once I petition? I plan on doing concurrent filing with 1-130/i-485/i-765. What are the chances that they will be called in for an interview because of this abandoned LULAC app and the interviewer asking about this abandoned/denied application? Thanks

most of the parents do have interviews, as long as they entered legally and never deported in absentia, overstay is forgiven

I have never heard of a LULAC application.

Just wondering what might have happened with it.

No they just sent them a notice saying that the case was abandoned and they denied it. No other letters stating anything about deportations or anything of the sort.

B1/B2 is only valid for few months and potential for valid extension. I am not certain, how they can be here for 15-years.

It appears that you can have them go back to their country and petition for them as your parents. Good luck.

They can adjust in the USA.

2/06/13: APPROVED!

They never left the country since their last entry on the b1/b2 visa in 1999 which they overstayed.

I've recently filed an I-130 along with I-485 for my mother. I have already submitted my I864 as the petitioner and primary sponsor along with the I864A from my husband as the household co sponsor. After a month of submission,I got this Request for Initial evidence stating that I need to declare any assets or find a joint sponsor due to unmeet 125% poverty guidelines My question would be Is it still possible for me to have another joint sponsor not living with us and who will file an I864 given that their will be only ONE immigrant?( I read somewhere that if their are two or more intending immigrant a maximum of two joint sponsors is allowed.) Here's my case breakdown

Me as the petitioner and primary sponsor filed I864

Husband as Household Co sponsor filed I864A

Person not living in the same house with enough income will file I864???????

Another question they're also asking for a copy of the applicant's foreign birth certificate as shown in the picture attached, are they referring to my Birth certificate as the petitioner since they also mentioned the applicant or petitioner or they are referring to my mom's birth certificate? Lastly, Can I also send a copy of our pictures together (mom and I) to further boost the case eventhough they're not asking for it to avoid future rfe. Any help would be greatly appreciated. you can't combine income with a joint sponsor, so you would need someone with income that can cover, him or herself, his or her family if they have one, and your mom.

your husband's income wouldn't matter anymore.

there is no attachment for the other question

Thank you so much for the immediate response. My second joint sponsor hve met the 125% poverty guideline, So its ok to use a another joint sponsor aside from me as a primary sponsor/petitioner, my husband as a household co sponsor and the other person who will be a joint sponsor so we are all three sponsors. I saw it somewhere that they are only allowing 2 joint sponsors if their are 2 or more immigrants but in my case their is only one intending immigrant. Thank you

Hlo, Any help would be greatly appreciated especially for those who got the same rfe where it says

Submit a copy of the applicant's Birth Certificate issued by the appropriate covil authority. etc.

I was the one who submitted an I130 and I 485 for my mom. Are they asking for my mom's Birth Certificate which I have already submitted or they are asking my Birth Certificate (have submitted before) since it is in my Birth Certificate that show my mom's name as my real mother? Pls kindly enlighten me with this. Thank you
