question on marriage certificate

Timeline

My fiancee and I will be married in Ontario in a few weeks. At the ceremony the officiant will give us a "Record of Solemnity" showing that we are married and he presided lawfully over the ceremony. Then the marriage is registered and the certificate can take up to 10 weeks to be issued.

My question is whether I can initially send in the Record of Solemnity with our I-130 application in lieu of the certificate and bring the certificate in with us for the interview. Tacking on another 2 1/2 months to this process isn't something I really want to do right now. As it stands at the moment she can't return into the country because the border authority has told her she doesn't have "significant enough ties to Canada" since sh lost her job and we're not sure how long this will take to fix. She is currently looking for new employment but even then it's not likely to enable her to re-enter the US immediately. Until then I'm stuck only being able to see her once a week driving 5 hours round trip instead of her being able to stay with me for a few days at a time.

Any information or advice is welcome!

Also, I'm really glad that I found this site! The guides and info have already been a great help for me in understanding how to fill out the forms, what's needed and what to expect.

The Record of Solemnity cannot replace the marriage certificate.

Here is the site for ordering the certificate online, which can be much faster than ordering by mail: http://www.ontario.ca/en/services_for_residents/121591

meanwhile, you can start filling out the I-130 without the marriage certificate, the USCIS office will send you a letter RFE (Request for Evident) which would take about 2 months after you've sent out the I-130.

Would this have any benefit of being more expeditious or am I just as good or better off waiting until getting the actual certificate to initiate the process? It seems like submitting just to get an RFE wouldn't save any time at all unless it cuts down on processing time and will go faster once I submit the requested documentation (marriage certificate).

Usually, the USCIS will take 3 to 4 months to look at your application. When my husband petitioned for me, he didn't send in the marriage certificate, so when he received the REF in the mail 2 months later, he sent it out with all the evident needed, and the petition was approved a month later. So I would say it does save time.

Interesting, thanks for the info! I just found out that one of her aunts is a supreme court justice there so she's going to call the vital records office in Thunder Bay and see if she'll be able to get the certificate generated quickly. If not then I may do it the way you suggested.
