My wife of 3 short years has left me along with her daughter. Divorce is filed. She is after me to provide health insurance for her daughter. Let me say this again...she left me. I never wanted this.

Short question: What, if any, are my obligations to provide health care to either one of them?

According to my guess, If that is mentioned in your final decrees then you have to. If it is not and as a good will you would like to otherwise no.

Nothing is mentioned in the final decree about health care, alimony or child support. She abandoned us for reasons I won't get into here. The long and the short of it...she abandoned us. No good will there. I just feel bad about her daughter.

In a perfect world, I would. However, as she is not my daughter, my company will not cover her under my plan once we are divorced. She took the step-father in me out of the equation when she left me. Is there a loophole for me to provide coverage for her?

You say she left you with the daughter and further down you write she abandon us?

Is the child with you? Will you ever she her again if she is not with you?

If you want to or not is up to you. Just remember whatever her mom did it's not the child's fault.

Guys, the question is whether he can legally cover her as a dependent when he is no longer her step-father. It's unfortunate and it sounds like he wants to but can't.

This is a question for your insurance company or you can maybe pay for private insurance.

This is not immigration related by the way.

I thought the OP was questioning whether he is liable under I-864.

It's more of a moral question, but that will obviously come up as well.

This sounds like it could get complicated legally. You're saying she "abandoned" you, but she's still in contact with you and is now demanding you to provide health insurance to her kids, which are your step-kids, and therefore you now have zero legal ties to them?

You just need to call the insurance company, but if you're not the legal guardian of the child, seems like it's probably complicated. Might make more sense to get a lawyer at this point. Sounds difficult...sorry to hear about all this.

Honestly, if the insurance companies refuse to provide her coverage, sounds like your ex-wife needs to re-think this whole divorce thing. Seems like she should've thought about doing a separation and not a divorce which would've allowed you to keep them on your insurance. Seems like it's her fault, not yours, if she ends up being angry about not getting what she wants. Feel sorry for the poor kid stuck in the middle of all this.

She was already thinking about divorce way before her daughter got to US.

You should not feel obligated to do anything for them.

She got what she deserved.

Luckily you did not adopt her daughter, otherwise you will be in a bigger money pit.

If the child is not legally yours,I doubt any insurance plan would allow you to insure her as your daughter. You can however, help purchase separate insurance for her if you wish (since it was not required under your divorce).

you can buy her an individual policy if your state participates offers a health insurance exchange. start with healthcare.gov to find out if your state participates.
