USCIS Tier 2 Rep Call Center Escalation? I751

So I called USCIS yesterday and spoke with at tier 2 rep. He said he was surprised my case hasnt even moved yet, so he escalated it. How long does it usually take once Tier 2 escalates a case? Also I asked him about filing my N400 he said I cant until the I751 is done. Im a little confused I thought it made them look at my case?

You can't trust the Misinformation Line. Case in point. If you are still married to your USC spouse, you can file your N-400 3 years minus 90 days from the "Residence Since" date on your GC. Include a copy of your NOA1 for your I-751 in your N-400 packet.

Odd he said he was an USCIS immigration officer for 26 years. My 90 days is in 4 days time. I was going to start pulling all my documents together and getting it out next week.

The people who answer the phone don't work for USCIS, it's contracted out. Only Tier 2 people actually work for USCIS. His information was incorrect. Happens all the time. You can file your N-400.

They'll tell you they can't approve the N-400 without making a decision on the 751, which is true. But filing the N-400 forces them to make a decision on the 751.

They'll tell you they can't approve the N-400 without making a decision on the 751, which is true. But filing the N-400 forces them to make a decision on the 751.

Sounds like OP was told he/she can't file the N-400 before the I-751 is approved, which is inaccurate.

You are correct. I filed for my N400 before my I-751 was approved. It was taking a while so i decided to "push" it with the N400. I was called for the N400 interview but I was only interviewed for the I-751. I was told I would be called back as soon as the I-751 is approved. It was approved three months after interview.

What do you mean by Tier 2 escalated the case? Did he transfer your call to a Tier 2 supervisor? or just created a service request on your behalf?

You can file N400 while I751 is pending as long as you are qualified for N400. Check section B.2 at https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume12-PartG-Chapter5.html

I exactly did this myself, applied N400 while I751 still pending. My I751 was approved along the way (1 week after I sent the N400 package to be exact), went to the N400 interview with the 10yr card and not a single question was asked on that part.

Maybe I misunderstood, but either way, OP was told he couldn't file his N-400 until his I-751 is approved. That is incorrect.

Absolutely don't wait any further if you are eligible to file N400.

There is still an ongoing debate on VJ whether the NOA extends GC 1 year from the date of the letter or the expiration of the GC but general consensus is 1 year from the expiration of GC. In your case 12/23/16.

I had assumed that only the 26 year "USCIS" vetern on the phone at Tier 2 confused the hell out of me, even told me to go do an infopass appointment

I called USCIS Tier 2 Officer today and they made me to understand my case has not been schedule for Biometric Appointment because the ROC might take up to a year,because they don’t want the Biometric expired before my case is been approved,does any body experience suc?,please input I need to be sure I gat the right information

That is correct, so don't panic. You will be called in for the biometrics, but maybe not right now.
