K2 VS Follow to join benefit????????

Hello,

I am pretty confused and I need you guys help. Please don't pass this but help this Dummie Dum Dum :crying::crying::crying:

I came here with K1 and now my AOS is processing after marriage.

I want to bring my son (From my previous marriage) to the States and he is already mentioned on my K1 visa form and AOS form too

So, at this point.

A - Should he get K2 visa no matter what and come to the States then get AOS? just like I did?

or

B - My son can have a Follow to join benefit???

I read this below....

Following to join benefits for children

If you had children before you become a lawful permanent resident, and your children did not physically accompany you to the United States,

and you would now like your children to join you in the United States, your children may be eligible for following-to-join benefits.

This means that you do not have to submit a separate Form I-130, Petition for Alien relative, for your children, and your children will to have to wait any extra time for a visa number to become available.

Your children may be eligible for following-to-join benefits if:

- You immigrated on the basis of a fiance petition.

I tried to call to NVC for this benefit but it's HARD to reach them :cry:

Anybody has an idea???

Yes he'll come as a K-2 and then adjust.

Contact the embassy and they will tell you what will be needed from now on for your son.

It was a long holiday there and now weekend so I was nervous. LOL

However, I asked to the embassy in Korea and asked what I need to get K2 visa for my son. They told me that I'm already married after I came to the States with K1, so my son needs other process. Not K2 visa. So now I'm confused!!!!!!!!!!!!!

They are talking about CR-2 but a K-2 follow to join has to been done with in one year from you arrived. Did you tell them it's a follow to join?

As I know, you are right. My son should follow to join with my K1. I arrived here January this year so he can get K2 visa. This is kinda really frustrating. My AOS takes almost 8 moths but still ready for scheduling my interview...Ughhhh

As I know, you are right. My son should follow to join with my K1. I arrived here January this year so he can get K2 visa. This is kinda really frustrating. My AOS takes almost 8 moths but still ready for scheduling my interview...Ughhhh

Sorry your AOS is taking so long your office must be back logged on interviews.

I would call them again and explain the K-2 follow to join maybe even send documents from the USCIS webpage if they for some weird reason don't know the rules

Thanks for helping. I really do. I just emailed them again for K2 follow up and I will go to the field office for my AOS too.

If your son was mentioned in your I-129F petition, he has a year to join you. So, I would probably stop calling the Embassy and start acting...

I believe he is unmarried and under 21,..???

From your timeline I see, your K1 visa was issued Nov. 16, 2015. Not much time left, but still possible to get it done.. Depends on a medical exam and an interview availability dates in your country, of course. But I DO hope it's not long wait..

So, you should go ahead and try to figure out a medical and interview availability dates.. If you see her son can make it (both - medical and interview) by November, book an appointment, fill out DS- 160 and so on..

For his interview he will need

1. Passport (travel document)

2. Birth certificate.

3. Police Certificate

4. Copies of YOUR passport pages - biological, K1 visa page and a page, stamped at POE.

5. Copy of YOUR I-134

6. Copy of your I-129F approval (NOA2).

7. Copy of YOUR marriage certificate.

My son joined me later, so i've done this before. It doesn't matter if you have already filed for your AOS or not.. The main, if a kid was mentioned in your I-129F, he cannot enter the US BEFORE you, only together or after you. And he still has a year to join you no matter what..

Hello, 

 

im running into the same issue and this was the only thread I can find for follow to join. 

 

I just received my fiancé Manila case number and she is ready fill out her DS-160 form.  She has 2 kids that will be coming as well with the exception of the eldest which she will join to follow once she is done with school in March.  I was confused about the process after reading the steps online.

Can all 3 submit a DS-160 and pay for medical all at once or does the follow to join daughter have to schedule her appointment closer to when she is coming here to the US.

 

I know that she has 6 months after the K1 visa is issued but we might be cutting it too close and had to resort to follow to join to be on the safe side. 

 

If I click on the Follow to join and when she's ready as long it's before the one year all she has to do is pay the the fee and submit a DS-160 and schedule an interview an medical right?

No only the kids that are coming with the mom do the DS-160 and the medical now and all fees. The older daughter will do that when she is ready to go ahead with her visa.

 

It's not 6 months from K-1 it within 1 year of the mom getting her K-1 visa issued.
