Fiance Visa I filled the i 129 and its's still pending but my wife is pregnant, do I report that or do I report it when my child is born at overseas?

My wife is delivering our first child at overseas and I have not reported this in the case, will this cause delays and problems if i reported now or should I wait until case is approved and than reported when the child is born? Help me with suggestions please?

Who is the USC? No, it wont be a problem, just some more paperwork. However, if you are married and filed for a fiancé visa, you have a problem

If it isn't difficult, it isn't worth it.

 

K1 process

9/24/15: I129f sent

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

I assume from where you are posting you mean the I-129F to accompany an I-130 for the K3 (an obsolete visa.)

If you qualify the child can get a crba. If not your child will need an i-130

Confusing. The title says "fiancé" but then refers to "wife". Are you married or not?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Agreed. 

 

A fiancé and a spouse are two different things. 

 

If your filing for k-1 and your married, you can expect a denial. Might as well cancel that application and go the k-3/cr-1 route. 

Our Timeline:

 

Met the woman of my dreams: 7/5/2014

Married the woman of my dreams: 1/18/2016

First child with wife born: 6/6/2016 (yay!)

 

K-3 to CR-1 Visa Processing:

 

4/11/2016:   I-130 Sent

4/13/2016:   NOA1

8/26/2016:   NOA2

9/20/2016:   NVC Receipt 

10/4/2016:   NVC Case # Assigned (My birthday woohoo!)

10/4/2016:   Submit DS-261 

10/5/2016:   DS-261 / AOS / IV Bill Recieved
10/6/2016:   Paid AOS & IV Bill

10/7/2016:   Send AOS & IV Package 

12/15/2016:  CC @ NVC 

12/28/2016:  P4 Received 

12/9/2016:   Interview Date Received for 2/9/2017

2/9/2017:     Interview Result: Approved

2/14/2017:   CR-1 Visa Received (Visa in Passport)

2/21/2017:   US POE Entry @ LAX
