Hello :)

Me and my husband are finally ready to start my AOS process and we are getting ready to file I-130 form.

Even though there are multiple articles on what should be the checklist I'm still posting this now, since everyone's situation is a little different.

We are filing from abroad.

1.USCIS fee 420$ in check.

2 .I-130

3.G-325A( Both for me and my USC husband)

4. Passport sized photos of both me and my husband

5.Cover letter

6.Copy of our birth certificates

7.Copy of marriage certificate-Question-Should I include Apostile of our marriage certificate or just copy of certificate itself is enough?

8.Evidence of joint bank account'

9.Flight tickets

10. Multiple photos of us we took throughout 3 years of our relationship.

11. Evidence of same residence

Also I have changed my last name year after we got married, I moved to my husband's last name. Should I include the paper that explains why I have my last name changed?

I would appreciate if you could take a look and tell me if I'm missing something, thank you!

Are you adjusting from a K1? You may want to correct your profile to read AOS.

If so, you can use this guide:

From what you listed it looks like your missing some items.

You don't need a letter explaining your name change. I;m sure they will see that it is now the same as your husbands and realize the reason for the change.

Well, I'm not adjusting from any type of visa. The only visa I have atm is B1B2 valid for another couple years. But I believe I'm not adjusting from anything but trying to get my permanent residency through marriage/Green Card ..Thanks, I'll take a look at guides.

Timeline

Your first post you stated your are "ready to start my AOS process" AOS = Adjustment of Status. So unless you came to USA on a spousal visa 1IR/CR1 (which then AOS is not necessary) you must be adjusting from your B1/B2 visitors visa after marriage to receive permanent resident/greencard status.

It's helpful if you correct your profile so that your posts go to the proper forum where VJers experienced in that area can respond and help you. RIght now your listed as applying for a spousal visa which does not seem to be the case.

Your terminology is wrong. You are not adjusting your status. Only immigrants in the USA can adjust their status.

You will be applying for an immigrant visa after the petition from the USC is approved.

You're confusing us.

So you are in the United States right now on a B1/B2 visa? And adjusting your status from tourist to permanent resident. You are already here, you don't need a visa. Visas are used to enter the United States. IR-1/CR-1 visas are issued to people who are in other countries and that visa allows them to enter the United States. You are already here. You are not applying for an IR-1/CR-1 visa. You are here on your B1/B2 visa, which is fine. So you are applying for adjustment of status from tourist to permanent resident (based on marriage to a US citizen). You are NOT applying for a visa, since you're already here. You would be applying for an IR-1/CR-1 visa if you were in Georgia (the country) right now.

Please change your profile to Adjustment of Status. You are not applying for a visa....unless the foreign spouse is NOT in the US right now?

Where are you physically located right now, the US or abroad??????

If you are currently abroad, you are applying for a visa. If you are in the US, you are adjusting status, you are NOT applying for a visa. People can't give you the correct information if you conflate terms.

All you need is a photocopy of the petitioner's birth cert...no apostille or certification needed. Also, beneficiary's birth cert is not required with I-130...it is submitted later to the Department of State.

All you need is a photocopy of the petitioner's birth cert...no apostille or certification needed. Also, beneficiary's birth cert is not required with I-130...it is submitted later to the Department of State.

The only thing I confused was I forgot AOS was only for those who are already in the States aand I'm not. It's not easy to keep a track of billion different names for different processes etc. But anyways, thanks)

You can say that again! Especially when AOS means both Adjustment of Status and Affidavit of Support. Confusion tends to happen. No worries.
