Hi Everyone!

My wife just joined the navy and is currently in A-school at greatlakes, IL, she's gonna have her swear in next week to become a US citizen after that then she will petition me. I'm currently here in Texas living with my brother and being an Australian/Filipino Citizen I'm only allowed to stay here until October 14 2016, I just have 3 months privilege of stay. now my question is what is our best way or what is the best way to start my petition? which steps do we follow? and is it going to be an issue since I'm only on esta? can I physically stay here through out the petition process?

~ Moved from "IR-1/CR-1 Visa Process and Procedures" to "AOS from Work, Student and Tourist Visas" ~

Organizer hat off:

Once you file for AOS and receive your NOA1s you enter a new period of authorized stay until your application is adjudicated.

In fact, once it is filed you cannot leave the US without Advance Parole (AP) in hand, otherwise you'll application will be deemed abandoned and will be denied.

Do I have to? bcoz in the forms there is a question if the the person to be petition is currently in the country? doesn't that overrule the ESTA(VWP) status?

Can you clarify? I don't understand your question.

Moved here using VWP and now OP is just waiting for wife to become USC so she can petition him and he doesn't have to leave.

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license
