K1 vs cr1 please help!

Hi everyone! I am a us citizen,just got married legally in Morocco the beginning of August. I didn't know that the K1 is faster than the cr1!

Please help me decide if I can still file I129f even though we are married just to speed the process? I don't really care about her having to work right after she arrives to usa.

You can't file the I-129f if you are married. It is for unmarried persons only. You need to file the I-130 now.

The K-1 is a fiance(e) visa. It is used before you are married to bring the foreign fiance(e) to the US in order to marry within 90 days of entry via the K-1. There are some good points though with the CR1, it will come with an immediate GC upon approval and entry in the US, so you won't have to go through an AOS process. Of course the time apart during the processing period can be difficult, but it won't last forever.

No, your only option is the CR1

Actually, consider it a good thing that you didn't file for the K-1. It has a higher rate of denial in Casablanca than the CR-1 does, and the spouse visa has other advantages over the K-1. I'd say the only advantage of the K-1 is being able to be together sooner (and sometimes, the difference is only a few months sooner than the CR-1), but the terms of the K-1 can be stressful for new immigrants (such as not being able to work for a bit at first).

If you file your I-130 with great attention to detail and strong relationship proof throughout the process, you have a good chance of getting through the process at a good pace. Just make sure you follow the guides and read through the forums on VJ to find answers to questions you may have and prepare yourself before every next step, you'll do just fine.

Hi thank you for getting back to me sooner!the reason why I asked that question is because I have an Egyptian friend who got married about a year ago and someone recommend to file for K1 Visa and not marriage visa because it will take about a year-and-a-half so he did file for fiance visa and his wife got here in about 6 months, I have no clue how that is possible! And I was attempted to do the same thing I just don't know what's going to happen if she they find out. I don't even know how they're going to find out. It seems like you have been in a similar situation by marrying someone from Morocco is that correct?

If you're in the USA, you don't need any originals to send with the petition or to NVC. The only time the original marriage certificate will be needed is at the interview at the consulate. So your spouse can scan the marriage certificate and send it to you for the I-130 (I recommend your spouse get it translated in Morocco and send you a scan of the English translation as well, because you'll need to send it with the I-130, too). Then when your case gets to NVC, your spouse can email you the scans of all of their original civil documents and you'll print them and send them to NVC.

The time it takes depends on a lot of factors that are different for everyone.

I filed our I-130 in February and my husband just got approved at his interview yesterday, and we didn't have any expedites, but I believe we got really lucky because our petition was assigned directly to Potomac Service Service (we don't have control over which location our petitions get assigned to) and they were moving really quickly at that time.

Some people take longer than others, it just depends on what your situation is (by situation I mean whether you have a really common name, if you have a criminal history, you have plenty of relationship proof, etc).
