Arrest record in Jamaica

My fiancé has 2 arrest in Jamaica. First one smoking weed and second driving without a license. Before we file what issues are we looking at with these two arrest? He never spent time in jail he payed the fine and it was resolved. If anyone could help I appreciate it!

If it's the beneficiary who has the arrests it will need to be disclosed at the interview stage. It needs to be disclosed when filling out the DS-160 (for K1). He's very likely going to be questioned about it at the interview.

You will need to seek advice from an immigration lawyer. Jamaican views of arrest, fines, and jail time are different than U. S. standards. He will need to answer specific questions about the marijuana charges. He will have a ban based on the drug charges, and will probably need a waiver.

Just chiming in but someone with more experience or expert opinion can maybe best answer. Go to the tax office to pay for certificate and then take the receipt to Kingston to get the record. A simple search will show you the fees for regular or expedited service. Also, from what I've read about other cases, an admission of smoking marijuana (which in your case he has an arrest record) will get an appointment with a psychiatrist and a one year ban. But as I said, someone with more experience could best answer.

May Pen Clarendon obtained the official police certificate from kingston and he picked it up at his local police station about 30 days later. You can pay more $ for an expedite.

2. Smoking ganja is legal in JA now. I assume his incident occurred prior to October 2015. Regardless, it matters what is legal in the USA.

3. My fiance was arrested in 2005 for smoking ganja, did no jail time, paid a $10 fine. He was found inadmissible and needed a I-601 waiver. He also received a one year ban for past use.

Only 2 ounces is legal, over that is illegal.

"Smoking" is legal. Thats what I was referring to as both mine and the OP Fiance were arrested for that. Possession is a different charge.
