CBP doesn't understand one year extension

Hi VJ,

Just thought I'd bring this to your attention - I know it's been discussed how long the one year extension is for, but CBP does not understand that it's from the green card expiration date.

I went through POE in Philadelphia and the CBP agent stamped my passport as having a 751 extension valid until one year from my NOA date. I wasn't in the mood to correct him (and it doesn't really make a difference, not sure why he even wrote that) but just wanted to give you a heads up.

I think it's important to point out that your particular CPB officer did not understand the rules. Surely ALL CPB officers are not misinformed.

I wish you HAD corrected him so that he wouldn't make that mistake with others.

Miscommunication between USCIS and CBP is a long discussion but it's absolutely USCIS's fault that they leave that decision open.

Extension letters could easily state "conditional resident status is extended for a period of one year from the expiration date of your GC", or even better why not put the actual expiration date on the letter?

We went through POE at JFK, and the agent didn't even ask for extension letter or look at it. Stamped the passport as entry allowed and that's it (doesn't say the status or expiration date).

During AOS we came in at JFK with an AP, and they didn't send us to secondary, and the agent barely looked at the AP card, looked more closely at the K1 visa, stamped the passport as K1 status, right next to the previous K1 entry stamp (even though K1 is a one-time use visa), and let us in.

When we came back, the CBP officer stated that hubby's extension letter was only a receipt. Pulled hubby into secondary, confiscated my US passport, and held us (separately) for about 2-3 hours. Most of the other officers acknowledged that we had the proper documentation and were apologetic for that officer's behavior.....

I think the chance of encountering an inexperienced CBP agent is higher at airports that do not see many international traffic. Vegas is not a small airport but do not get much international traffic.

Here is the deal, people going through I-751 are only a tiny tiny portion of all GC holders. Maybe like 1-1.5%. It is not a every day practice for CBP agents to deal with ROC letters. Bigger airports (JFK, ORD, MIA, ATL, LAX, SFO, HOU, etc.) get most of the traffic and they are probably more familiar with the extension letter. Smaller airports and land borders are probably the most risky ones to deal with. It still shouldn't be an excuse for CBP., they go through these in their training and I am sure they review policies and such annually.

True, Charmander.... but this was @ the International terminal here in Vegas.... The officer wouldn't even read the first few sentences of the letter, and told me that he knows his job and what he is looking for. Not to mention, he couldn't even look us in the eye and tell us it was incorrect. The officer who took my husband back, even saw my passport and my husband's letter and questioned the 1st officer about holding us. The first officer just said to him, "I don't care, and we are keeping her passport, too." I had started to get sick a few days before we came back, and even told him that I was sick and needed to leave the area.... he did not care. I did file a complaint w/ CBP, but, of course, they can't give me any information other than the issue has been addressed and they have the right to search/detain anyone they want. I get that, but to lie to us and to tell us the extension letter was not what we should have (when we used it throughout the trip, as well as to get my hubby a Schengen Visa - other countries government personnel know more about the letter than our own officers??!!) is quite ridiculous

Of course he knows his job. He would even claim no one in the entire CBP knows the regulations better than him. It's never a pleasant experience after a 10-12 hour long flight having treated like this. Regarding your complaint, they probably just made him go through the training material again, that's it.
