SSA Screwed Up

Timeline

Fiancee applied for SSN in April. We saw the computer screen, all correct. Afterwards they gave a paper which had the last name spelled incorrectly. We called, they said to wait until the card comes in to fix it. Last week, after weeks and weeks of calling, they cannot process it because of errors and that was it. They wiped their hands of it. I am taking time off from work tomorrow (risky, but I got no choice) so we can go down and get this to fix it. We got until Nov. 1 when I have the chance to get her on my (poor and low) medical insurance. Obviously, her visa expired because they waited to long to return our calls and actually do proper service and make a call themselves to followup on what they see as an error.

What do you think we will need to bring down for this event?

If her I-94 expired, you won't be able to get her an SSN now, only once she has her EAD.

You don't need a SSN to put her on your insurance, if they tell you that, go to the person above until it's sorted.

everything you brought before and check the piece of paper they give you before you leave the window so you can correct it there. also health insurance can be gotten with an i94 number.

on a side note stop blaming then even if they are wrong you are going into their domain and must follow their rules. as sad as it is even if they mess up if you can't prove it then they assume they were right and some one is just mad at them trying to cover for them self.

Someone messed up somewhere. If the SSA had the information correct, then was it correct on the I-94? Is it correct in the USCIS system? Check and make sure.

I tried but the provider will only speak to the recruiters I am stuck with, and the recruiters will not make special cases for me. I have been trying for two months.

If her I-94 expired, you won't be able to get her an SSN now, only once she has her EAD.
You don't need a SSN to put her on your insurance, if they tell you that, go to the person above until it's sorted.

Yes. One cannot have health insurance unless they have legal status in this country.

As EM said, it will be doubtful that the SSN can be corrected until she has legal status. Correcting anything with the SSA is never advisable to undertake over the phone. Nevertheless not having an SSN doesn't prevent you from obtaining health insurance, but she will need to have some proof of being here legally in the country.

Well, in a word, yes. After getting married on the K-1, the next step is to file for adjustment of status (AOS) which has a fee of $1070. Did you not know that going into the K-1 visa process? You wife is out of status and accruing over stay days once the I-94 expires. She has no legal status in the US. She cannot legally work. She cannot return to the US after an international trip. She is not eligible for USC unit she has been a LPR for a minimum of 3 years and still married to you. In most states she cannot get a DL so she is dependent of others for getting around or using the poor mass transit system in the US.

If your wife finds her self near the Southern Border, she can be asked to show her documentation. Since she has none, she may be detained and brought before an Immigration Judge (IJ) who will tell her to file for AOS and may even give her a deadline. Violate this court order and she can be deported. She will have to live with the SSC as it is until she gets her EAD or GC.

Just to answer this question mentioned, yes, planned on doing the AOS when we have money. Not expecting to do so sooner than later. Takes me 50-60h a week to make rent (they just increased it). AOS was not something in mind before Christmas.

I just got hit with more expenses just today too, so money is not as easy as it is for others.

Money should never stop love. Otherwise, many people would not even do visas and forget the whole thing.

The money for AOS should have been planned and saved ahead before your spouse arrives in US.

Now she is stuck at home, unable to work and out of status.

Hopefully she does not have family commitment or pressure to send money back home.

Money should not stop love... But it is selfish of you to leave her in limbo status.

Or you should have dated locally to save all the immigration expenses.

Have to agree with Merrytooth. Money doesn't produce or stop love. Not having money gets in the way of paying for the immigration process though. Time should not hinder true love either. Your love could have waited until you had all the funds needed to complete everything that filing for a foreign fiance(e) entails. It is hard to be apart, but separation is a hardship that comes along with forging a relationship with someone that lives far away from you.

By the way, what happened with SSA? This was over 3 weeks ago. The OP was supposed to take time off to get it fixed but a new thread says no. The thread stated the computer screen was right and a piece of paper was wrong but it seems like it wasn't the actual card. Uh, when did they get the paper? Right then? It should have been fixed right then. SSA washed their hands of it because of errors? If the screen was right and I assume they were looking at the application input screen that the SSA employee was working with and showed it to them for verification, then the paper should have been correct and the card correct. The name does not mysteriously change in the computer system all by itself.

At this point, what difference does it make? Even if the wife had an SSN, she would not be able to work without an EAD, and EAD can only be obtained by filing for AOS at the same time.
