Good day house, i checked my i130 on USCIS and i got this mail from them. although my i129f is still saying pending. i am totally confused now and sad. pls advice

On August 22, 2016, we denied your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, Receipt Number xxxxxxxx. We mailed you a decision notice that explains why we denied your case and your options. Please follow the instructions in the notice. If you do not receive your denial notice by September 6, 2016, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

You can't continue with the I-129F because a decision has been made on the I-130. So sorry it's turned out like this.

You need to wait for the mail from them and see what the reasons are and then work on those issues and re-file once you have corrected the problems.

Wishing you luck on your second attempt.

Is your wife a member of Visa Journey?

Based on your previous threads, I think there was an RFE that wasn't responded to adequately.

She should join this site and get some guidance here from others that have filed for people from your country.

She needs to put a lot of information in the package. Next time, only file the I-130, forget the I-129.

As said, wait for the denial letter to see the reason before proceeding any other steps.

A direct denial of i130 petition is very rare without first asking for RFE. Was there a RFE issued and did you respond to the RFE correctly?

Do you remember you other threads when you posted about your RFE and they said give them 60 days for a decision. Well they denied you. Your wife will have to wait for the letter to find out why you were denied and if you can even refile.

No the I-129F can not move forward without an approved I-130. Sorry o You have to wait for the letter now.

my wife is not here on this site.. i will instruct her to join. i think she didnt file the RFE well. i am waiting for the letter

yes i got RFE in may which i responded to and i submited all they ask for

Why didn't she reply to RFE?

Did you send a marriage cert i just read your other topics

They filed the I129F to chase a K3 visa not K1 , K3 is allowed for married people. Free to marry only applied to K1 seekers.

This will not be over quickly. You will not enjoy this.

No he cannot just continue with the 129f and K3 are obsolete they will get a notice the 129f is cancelled.

Sorry to hear about the unfavorable decision but while you wait for the reason, review everything you submitted weather or not it was sufficient and begin to do some more research about what your next line of action is. No time to feel sad if you love your other half just rise to the challenge as long as you know your relationship is fully legit.

In the mean time begin keeping good records of communications if you have to travel and spend time with your other half begin planing that as well. Depending on what the reasons are, you may be able to get married and go the CRI route.

I didn't wait for any denial letter when we were placed on AP for KI (thanks to VJ) we were able to get as much information and asked questions which prepared us for the CRI.

At the end it will be all worth it.

Not sure why you put K3 visa here / it is a CR 1 you go for / no longer do they call it a K3

You may have been denied simply becasue the US citizen did not withdraw the K 1 visa application / many think this is not necessary but it is

you have 2 applications in their system / forget the K1 as you are married now / cancel the K1 by simply writing a letter to the immigraiton office handling the case

US citizen needs to wait, as others have said, and respond to the denial withdrawing the K1 at the same time

They are already married and this was already the petition for the spousal visa. Getting married again won't make them any more married. They are as married as they are ever going to be. They need to work on the reasons for the denial.
