PERMANENT RESIDENT CARD

Hello!

I've been looking in the forums for about an hour now but I still have some doubts about my questions.

I applied for AOS (got married on January with K-1 process) in February of this year. I had some problems with the I-864 forms so I got a request for evidence and my process got delayed. I ended up receiving my EAD and Parole to travel in the mail in late June.

My question is: How long should it take until they ask for an interview and how long does it take to receive the Permanent Resident Card?

I've read that sometimes they don't ask for an interview for the AOS and if that is the case, then how long will it be until I get my Permanent Resident card? We've been trying to find an apartment (in New Jersey) to move out from my in-laws house but apartment offices always ask for my Permanent Resident card so I just want to know how long do we need to wait until we can move out?

Thank you for your help!!

Neyla S.

Different factors make the wait time vary. I would say around 4-12+ months.

Many K-1 adjustment applicants do not have interviews. Did you receive an interview waiver letter? Usually those getting approved without an interview wait longer. Also, if you will be receiving an interview, how backlogged your local USCIS office is will make a difference in how long you have to wait.

You can check the filing threads in the progress forum to see how others that filed when you did are doing.

you shouldnt have to wait so long. I did the same processs for my husband in May 2016 i got asked for addition evidence and i had till aug 8th to send it i, we were so busy that we totally forgot and i did everything so last minute, they recieved the evidence the same day to be exact and on aug 18th he was already approved for the green card,as well today our case got updated that they already mailed out the green card. so hopefully we should recieve it by the end of this weeek. Hope yours is as soon as ours ! best wishes and good luck!

Neyla! Suerte! ?

I think that is case to case basis.. Not getting letter for interview does not mean you will wait longer to be approve.. Mine I came from K1 and i was approved for 3 mos for my AOS without interview.. It depends on what you had submitted on your AOS..

Notice I said 'usually' wait longer, and not always. I believe that they have started sending off some of the backlogged interview waiver cases to other USCIS offices so the wait time might be lessening for some.

And the amount of time it takes for the AOS to be approved has nothing to do with what you included. As long as you included everything required by the I-485, then you can be approved. Adding extras does not speed up your AOS processing time.

Totally agree with this, we sent no additional evidence just what was required and got approved without interview in 4 months ( RFIE for not signing the affadavit of support)

Everything crossed for a smooth and stress free journey

Thanks to everyone that responded!!!! It's been 6 months since we sent the AOS package, and about 3 months since I got my EAD but we haven't received a waiver for an interview or anything in the mail since the EAD. So maybe I'll be one of those people that don't get an interview which it sucks because it'll take longer for what you guys said. The office that process my case is in Elizabeth,NJ (or at least that's the office where they took my biometrical) and it's a bussy office I think.

Thanks to everybody for answering it's really helpful.

I think your office will be either Newark or Mount Laurel, depending on your county. Elizabeth is just doing biometrics (I am also in NJ, and you can figure out your local offices on the USCIS webpage). They also have timelines for processing, but they haven't updated them since June (which could be ok, because in June, they were processing I485 from .....July 2015....at least in Newark).

From what I read on other forums, people who sent their packages in Dec/Jan are starting to see some interview letters....

Hopefully you are ok waiting another few weeks... Good luck!
