2nd Interview for N400

Timeline

I went for my N400 interview 2 weeks ago. I passed the civics test and my IO asked me some questions form my GC application and told me decision could not be made. Now I have been asked to go back for a 2nd interview to finish the process. Is this normal? OR should i be worried.

yes, it's normal, that means there were certain areas that you didn't pass,

did you pass the written sentence as well? if so, then the English speaking portion wasn't so good,

did you have any difficulties when the officer asked you the questions?

I passed the questions, reading and writing. I am very proficient in English. The paper one is given after interview indicated I had passed that portion. But he still told me a decision could not be made.

It's not common, but it happens.

What did they ask about your greencard case? Is there anything unusual about it, such as you got divorced from the USC who brought you over shortly after you got the greencard, or criminal convictions etc?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Fraud and Lying to USCIS

If USCIS believes that your answer to a question is deceptive or untrue, your Application for Naturalization will be delayed and could be denied. It doesn’t matter if the error was innocent. You must make sure that your application for naturalization is true and accurate when filed.

During the naturalization process, USCIS will review your history. If the officer determines that a green card was issued (even many years before) in a fraudulent manner, citizenship may be denied. Likewise, other situations (new or old) that put the applicant’s good moral character in question will hold up the process.

So i did not want to reply before the interview. I recently went and I was questioned for an hour. They asked so many questions that they had asked at my 1st GC interview and in the interview to remove my conditions and many others i believe are from back ground checks.I came out of there with a headache and a promise from the IO to wait for the decision in my mail.

  • It is a painful journey when the whole things become so long. Seems like you had an interview for condition removal? Just curious what kind of questions were asked from 1st GC interview? i mean addresses etc or something very unusual questions ... Despite all, i think you should be ok. I only assumed they are the same questions they asked me during GC interview coz they kept on referring to my file. A little background- I was married for 4 years but now divorced. So the questions were about how we met, where we met, where we lived. Did we live together? How long did we live in a certain address.When did we start living together. who talked to who first etc.

I strongly feel the problem here is this and I hope others can learn from me, At one point in our marriage, my husband was in Alcohol rehab. Yet when they asked me if we had ever lived apart I said No. They asked me why i said we had never lived apart yet my husband was in rehab at some point. They seem to consider that as living separate. My question is, is Rehab not like a hospital? So if a spouse is in hospital will that be considered living separate? Also during my first N400 interview, when going through paperwork as they do, when we got to the point about divorced, he asked did you live together through out. The good thing is that at that point, while i said yes, I did point out that there was a point he was in Rehab.

I feel my IO is holding on to that technicality. I am just tired and this waiting game is not fun.

You're filing under the 5-year rule right? I'd think they wouldn't put so much focus on your marriage...

Not sure if you're familiar with the story of Rupert Murdoch's former Chinese wife Wendi Murdoch, but she basically seduced her married U.S. sponsor at the time to marry her for Green Card, and divorced in 2 years and 7 months, just enough time to remove condition. She became a citizen all before she met Rupert.

There are so many legal precedents like that, I don't understand why they bother to go hard on people just because they get divorced...

No! I never heard of Wendi Murdoch's story! but people like those are the ones who make it difficult for us. At this point I wish I had some superpowers to show my IO videos from my past. I am even thinking i shouldve kept my big mouth shut about the rehab because that is what started all this. But I guess being truthful can lead to a cost. i am thinking how they are wasting time on my case with the big case load they have for GCs. I understand they need to do this because there are some suspect filers but i wish they had something in place that they can use to confirm during marriage instead of waiting for when someone comes for interview. Like maybe doing random checks to homes because this is absurd. And yes, I am filing the 5yr not the 3yr which makes it the more absured

This is really unusual. Unless if there is some personal story which you may have decided not to disclose in public forum, then it is a different case. People get divorce, remarry and apply for citizenship and still get their citizenship because immigration benefit are granted based on whether the marriage was bonafied at the time parties were entered into marriage not the viability of the marriage ( in other words, immigration office can't make decision judging if the parties marriage will be successful or not, he/she must decided based on if the parties were entered into good faith marriage and if it was bonafied at the time they were entered into it) . Therefore those who get conditional green card and divorce before removing conditions are able to successfully remove the conditions because the when the parties were married they are entered into bonafied marriage.

So if the conditions on a green card was removed successfully, then the question of bonafied goes out of the window. The law allows for those who are still married until 3 years after issuance of the green card can submit application for naturalization 3 months before their third GC aniversary, and those who divorced should wait for another 2 more years.

Now immigration officer at this point can't question the viability of your marriage. The only question was was your marriage entered into good faith and when GC was issued, was is issued legally? If you have removed your conditions. Then you are all good!

How long were your husband in rehab? was he there for a long time?

I know every case has its own story. There is something which people don't want to share in public forum but just give the bird eye view of the case and based on that people like us try to give some suggestion.

If you truly believe that there is nothing such as recent arrest record, if you were never lived together or if you haven't filed taxes together while you were still married etc.. then they might question why it was done that way .. which will simply slow down your process but won't strip your privilege to become citizen.

Again the most important question here is if your LPR was issued lawfully is the only question which will determine whether to grant or deny your case. Divorce has nothing to do with it. They have the right to validate what you have disclosed in your application.

Again people marry and divorce frequently especially 1 out of 2 marriages are always unsuccessful in US.
