Timeline

My sister entered here with a tourist visa, she could stay in the country for 6 months but this time has already expired. Can I apply for a green card for her in this situation?

The only way her overstay would be forgiven is if she were married to a USC. She is not. She needs to go home she is in the red.

She should have left and came back. Legally.

There is a waiver that excuses unlawful presence over 180 days if she has an approved I-130. - the I601A.

I recommend not overstaying though, she should leave and come back via the legal route.

01/05/17 - Ombudsman says will receive Interview letter within 30 Days!

02/01/17 - Marriage Interview

02/02/17 - I-130 Approved!!!  :D

I recommend not overstaying though, she should leave and come back via the legal route.

She cannot come back....she overstayed already. She will not get another visa....

She needs to go home and not do any further illegal activity.

The waiver requires a qualifying relative which the sister doesn't have so no waiver and she still has to wait decades for a visa number for a sister

This will not be over quickly. You will not enjoy this.

the subject line of your post is "helping sister", you are not helping her if you advise her to stay in the US for even one minute longer. By the way, when she goes home and if you decide to petition her, you can not do so until you become a US citizen

Some of the post here may sound curt but it is truthful. You are NOT helping your sister nor any other immigrants who have a difficult time getting visas because previous and current visa holders do things illegally like your sister.

Do the right thing. Tell her to go back to your country. There is no path for her to obtain a GC and for good reason.
