Hi all--I stated before that my Pakistani husband's divorce papers were not accepted by USCIS in Nebraska for our CR1. He had the official NADRA computerized divorce papers, but they want an older one that takes 90 days to become final. We were sent an RFE requesting that this other divorce paper be provided within 60 days or they will cancel our CR1 and we will have to start over (btw, it took almost 6 months for them to even open our application, so we are looking at them opening our papers in Jan. or Feb., 2017 if we have to start over). My poor husband has been standing in line in 105 heat every day asking about getting this paper. They keep saying they will give it to him. We are an older couple who have known each other for more than 5 years, so time is of the essence since I am retirement age.

My question is this: Is there anyone to contact to give us additional time to get those papers to Nebraska if they don't give them to my husband in time? They have given us an Aug. 15 deadline, which was 60 days. The papers they want take 90 days to process, then I would have to get them to USCIS in Nebraska. This is the most ridiculous thing I have ever heard, in that he has been divorced for more than 8 years, has an official divorce paper (Deed of Divorce) from the government, and they are giving him a hard time, saying he already has divorce papers, why does he need others?

Is there anything we can do? I am so sad because we have gone through so much with visas, paperwork, foreign governments, and on and on.

i can give you best option send the same divorce papers to them if its accepted fine or else they will send you another RFE with 60 days time so you will gain another extra 60 days.... lol

Wow, good idea. BUT if they are not smart enough to see that it is the same divorce paper, they are pretty stupid...lol I thought about calling, but I'm sure they don't care....I'm sure if I did that, they would just cancel it, but I would be no worse off. I will try that. I wonder if I sent the same one in with a letter explaining that it would be another say, 20 days because the paper takes 90 days to process, until I could get them the other ones, do you think they would say too bad, and cancel anyway?

You can send the same papers with an explanation or official stamped letter from the registry that the papers are what is normally

issued. Bare in mind that USCIS can deny instead of sending a second RFE.

I have read somewhere that in some cases USCIS will extend the RFE dead line if documents are hard to get in some countries

and I would make an extension request through a senator or congressman, I would not attempt it by myself and keep record of all

communications between the senator's aid and USCIS if it is granted.

The problem with that is if you go to a site where you look at reciprical papers that are listed for each country, it says they (USCIS) do not accept a Deed of Divorce...which we did not know at the time. It was not stated anywhere in any application, plus Pakistan thinks that the Nadra (which is the official registration of a divorce) is enough evidence. What makes me sad is that another couple we know turned in a Deed of Divorce and it was accepted without question.

If they actually denied instead of sent a second RFE, what would we have to do then?

USCIS is looking for the divorce decree. It is my belief that the NADRA paperwork you have provided is simply the government record that the divorce was registered, exactly as the NADRA Marriage registration is not the marriage certificate but proof that the marriage was registered. There is no possibility that your husband has a copy of the divorce decree? Or can he try going to the court to get a copy of these things?

How did the other couple you referenced fair at the interview? The NVC and embassy did not make an issue?

I feel like our visa application/journey is rapidly turning into a tragedy. I was 59 when we met online, I'm now 65. We tried to get married in Serbia for 1.5 years, but they required extra papers that we didn't have. Then the next time, the judge rolled her eyes at my then-fiance when he showed her my passport to get a marriage license. (They hate Americans because of the NATO bombing.) Then they denied his visa renewal so he moved back to Pakistan(after he lived there for 3 years) because we wouldn't "put more money in our bank account." We even have land there and a business there as well.This was when all the migration stuff started also.

So I had to go to Pakistan (32+ hour trips) to see him, where we got married last Oct. As to his divorce, he and his wife did the verbal divorce thing where they say I divorce you 3 times. This is legal with Muslims. He never went to counsel where you go back and forth for 90 days until you get papers as he got stuck with all the bills anyway and they had no issues to solve. This was in 2008. He had no plans to every remarry. He registered the divorce in 2010 with no problems. Now they want him to go back and get the 90 day divorce. It's totally insane. They have no issues, his ex signed all the papers, and they have been divorced since 2008.

I reread the RFE letter they sent me. They say absolutely no extensions. I am so heartbroken. He has gone and stood in line for 3-4 hours every day for the past month asking for the papers. They told him he might could get them faster, so he keeps going. They said he would get them before 90 days, but what does that matter if he gets them the day after they are due back to Nebraska on Aug. 15? If they cancel our visa, do they keep our application and evidence or would they send it back? Our evidence/application weighed 6 pounds and was about 6 inches thick with proof of our relationship.I can't imagine facing having to do that all over again (at least I kept a copy). I have made 7 trips to see him. It took them 6 months to open our application, so we are looking at another 6-8 months before they even open our application again. I am so worried that by the time he gets here (if ever), I will be so old that we won't have much time together. He is somewhat younger than me, but has developed health issues because of all the stress, having to go into the hospital several times.

He would be so embarrassed if he knew I wrote about our relationship on here, but I'm desperate. He is an honest man who values his dignity and respect above all else.

I am at wits end...
