What are the qualifications/requirements to avail DCF? (merged)

I am from Philippines. Me and my fiance planning to get married here. He wanted to stay here few months before the wedding and wait for my visa,so we can go to US together. We are planning to avail the DCF way.

Kindly tell me, what are the qualifications and requirements? How many mos. he should stay here before we can apply? I heared 6 mos, is the counting right after marriaged or from the day he come here before the wedding?

Do he need to apply for permanent residence here or tourist visa will be fine.

Those who has experienced already,kindly share to me please. Thx in advance!

I do not believe being in the country as a tourist is sufficient for DCF. I believe that he needs to be a legal resident for a certain period of time before allowing for DCF.

I'm actually the one who's the US Citizen, I petitioned my husband. We arrived last November 2015 so I passed the 6 month requirement. The alien card is something that your fiance can apply for in the bureau of immigration just so that their stay here is legal.

Two major qualifiers for DCF,

1) The USC should either be serving in US army,navy or airforce and be stationed outside the US.

2) The USC petitioner filing for a (spouse, parent and i am not 100% on K1) must be residing in the foreign country on a long stay(not a few days tourist visa) where he/she intends to apply.

also, not all US missions abroad allows DCF. you will have to check with the one that falls under you. most of them are pretty prompt and will send you an reply over the email or check local US embassy web.
