Unsure which waiver needs to be mailed in

Hello all thanks, for taking the time to read the situation we are in .

I (Us Citizen) petitioned for my husband we filed for the I30.

He attended his consular affair interview in June 8 , 2016 and was given the blue slip.

On that blue slip it only indicated I-212 to be sent in. How ever we received following instructions in the mail and are beyond confused because it shows the 601 and 212 waivers but don't have any check mark.

The information im attaching is in spanish not sure if someone can help me out?

He was removed at a port of entry in June 2012 and never came back to U.S

The way i understood is he has to file both forms

1. i-212: because he is found inadmissible due to his illegal stay of more than 180 days in US and that he was deported from POE and this would ban him till June 2017. So need to file this i-212 for waiver of this issue.

2. i-601: because he is found inadmissible because he committed fraud by presenting false materials (documents) to the CO which could carry a lifetime ban. So need to file i-601 for waiver of this issue.

You should try sending an email to the embassy with it scanned

showing nothing is ticked. usually CO tick all that applies to you

I saw nothing about misrep on the form I would at least just consult

a lawyer or legal aid clinic to be safe.

Of course you'll need to file I 212 (permission to re-enter)

We received the same blue form In the mail but only need the I-212. It came with a cover letter though that indicated I-212. Did you receive a cover letter?

Where is the misrep...I saw none ...you need 212 re-entry app. sent to

the local jurisdiction you were sent from....I am not a fluent Spanish

speaker but I don't see where 601 is required.....you can walk into your

local legal aid & ask , or send an email to the embassy asking them because

one of both should be ticked if that's required

The form mentions fraud along with other things. However, nothing is checked, so there is no reason to think fraud or misrepresentation applies to OP.
