Popular Question -Can your spouse visit the U.S. on B1/B2 Visa

Hello Everyone,

I know this question has been answered few different times. But my wife has a current B1/B2 visa. She has been to the U.S. in the past. She actually had the B1/B2 visa before we met.

My question is

1) Can she travel to the U.S. on her B1/B2 visa while the I-130 is pending?

2) Have you or known someone that has traveled on a B1/B2 visa while the I-130 is pending? How long did she/he stay in the U.S.?

If she has a valid visa then she can get on a plane and fly to the USA. Whether she will be allowed into the country or not is another matter and is always at the discretion of the CBP officer on the day. A visa does not guarantee entry into the country.

That said, assuming she has a good travel history and can demonstrate that she has a life in her home country that she will be returning to there is a reasonable chance she will be allowed in.

I have travelled to the USA twice on the VWP to see my husband since we filed the I-130.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

Went with my wife, they asked a bunch of questions about if she had applied for any visas, if she was moving on this trip etc. but they were friendly, we told the truth and she entered without any problems. We brought a bunch of documentation to prove she had ties to Brasil, but we never were asked to produce them. Key thing with immigration is to always tell the truth.
