Timeline

Hello guys,

we just got approved for the K-1 Visa and I know for the K-1 visa interview I just need to one year tax return (Which I do not have because I started my job in March but I have my employment letter of my annual income and pay stubs as my proof)

For the AOS I noticed I need 3 years of tax return....

Can I still be the sponsor for my fiancee or I need a joint sponsor?

**I started my job back in March (Do not have 3 years tax return)

**I will make over the poverty guideline to support my fiancee

I know I am still just in the K-1 visa process but I like to think ahead.

if i can't sponsor her I will need to look for a joint sponsor.

Any help would be appreciated it.

You do not need to send 3 years of tax returns; you need to send one year of tax returns (if you were required to file). But you need the "total income" number from the tax returns of the last 3 years. If you didn't file because you weren't required to file (because your income that year was under the filling threshold) for some or all of those 3 years, that's okay, and you just put N/A and attach a statement justifying that you weren't required to file.

So i haven't filed any tax returns yet. I just started my job back in March.

I got an employment letter from my boss forecasting $25,000 annually.

Can I (Petitioner) just use that on the I-864 or Do I need a Joint Sponsor?

Hi,

Did you have income abroad in 2013, 2014, or 2015?

Noticed that you have a Taiwan flag and going through the US Embassy in South Korea. Thought you might have been living there for those years.

The US Embassy will look at current income and a totality of the circumstances. Your short employment history will hurt you since you can't show a history of a reliable income.

Line up a Joint Sponsor in case you need one.

That should be okay, though it's hard to predict how the consulate will handle it. Remember to include as many pay stubs as possible and the employer letter.

You are dealing with the I-134 for K-1 right now, not I-864.

Yes I am currently dealing with the I-134 but as I stated above. I am just thinking ahead trying to gather things up.

so if I do need to joint sponsor I will need to find one.

No I do not have any income prior to 2016. This is my first full time job.

My job now will be above the poverty guideline and I do have a house with no mortgage from my parents.

On the new I-864 stated that

"You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home."

and I do have some savings in the bank account.

Do you still think I should get a joint sponsor just to be safe?

good luck with finding a joint sponsor. When your prospective sponsor finds out that he's on the hook for medical expenses and everything else if you divorce, etc, for 10 years, they will not co sign.

Why on Earth would a joint sponsor be "on the hook" for medical expenses?
