how many forms for I864?

Hi,

I have read that we only need to pay fee once to file affidavit of support form even though there are two intending immigrants. My question is do we also only fill out one copy of form I864 and I864A or one for each intending immigrant? I think it may be one set of forms for both since there is a spot to put down both of the immigrants but I want to double check.

04/11/2012 - Informed of interview via phone by DOS/ Got P4 email from NVC a few hours later that same day (May 4th)

05/04/2012 - Interview (APPROVED)
05/10/2012 - Visa ready and picked up at domex
05/15/2012 - POE in Boston (together)
U. S. A
05/29/2012 - Went to SS office to apply for SS card
06/01/2012 - Welcome letter arrived (Received about 3 of these)
06/05/2012 - Green card arrived
06/15/2012- Back to SS office with green card to reapply and inquire about delay
06/18/2012 - Picked up SSN at SSA office
06/22/2012 - SS card arrived by mail

04/24/14 - Sent I-751 to remove conditions

06/09/14 - Biometrics

11/2014 - RFE from USCIS requesting more evidence before approval

Late Jan - Sent further evidence of marriage

03/05/2015 - Got letter of approval for removal of conditions

03/15/2015 - Permanent 10 yr green card received via mail

it depends on who you are filing for?

who are the beneficiaries? because some aren't derivatives

My husband, a USC, is filing for his parents.

no, parents are separate petitions, they aren't derivatives, I hope he filed an i130 for each one of them, since parents aren't derivatives

so they must have separate affidavits of support

one i864 and i864A for each of them

but as you said, you only pay once

Also I remain confused about the household size :ranting:

So if husband files just ONE I864 and ONE I864A, in part 5 under "persons you are sponsoring in this affidavit" it says provide the number you entered in part 3...so is that BOTH his parents as in 2, or just 1. My guess is 2 which would make the total household size 4 total which would be my husband, myself and his parents.

Yes he filed two I130 separately. That's a bummer. Who is considered a derivative?

hi

derivatives, are married siblings and married children

the spouses and children are the derivatives and they come all together

the sibling or child is the beneficiary and the spouses and minor children under 21, single are the derivatives

I'm not sure if the household size is 3 or 4
